Attorney Larry Klayman Jumping Into Obama Eligibility Legal Battle in Florida and Elsewhere

Iconic public interest attorney Larry E. Klayman is jumping into the long simmering Obama eligibility battle and will represent clients in Florida and other states to challenge Obama’s inclusion on the ballot

Klayman, the Founder of Judicial Watch judicialwatch.org and Freedom Watch freedomwatchusa.org (he is taking cases privately), is the only one to ever successfully sue a sitting President (Clinton). He worked on the Gore v Bush 2000 Florida election lawsuit and knows his way around relevant Florida laws and jurisdictions.

He also represents Jerome Corsi, of “Swiftboat Veterans Against John Kerry” fame, in an action against Esquire Magazine for its alleged attempt to sabotage sales of Corsi’s “Where’s the Birth Certificate?” book, released in 2011. Klayman also obtained a court order to force Obama to comply with FOIA requirements in disclosing info about Obamacare planning meetings regarding Supreme Court Justice, former Obama Solicitor-General Elena Kagan.

Larry’s entre into the Obama eligibility lawsuit arena was facilitated by the Obama State Ballot Challenge 2012 (OSBC) (obamaballotchallenge.com) organization. The group’s Communications Director, George Miller, said it was necessary to bring in a heavy hitter who knows how to force governments to be accountable. Sam Sewell is the group’s Florida Project Manager and OSBC Director Pamela Barnett is the California Project Manager.

Sewell stated “An analysis of several national polls on the subject of AKA Barack Obama’s eligibility shows that about half the citizens in American are unsure or don’t believe that he is eligible to be President. It makes sense that Obama supporters would want the issue settled along with everyone else. I would conclude that those opposed to releasing all of Obama’s history are frightened of the truth, just like AKA Barack Obama.”

Klayman, who took the case in his private capacity, started by representing current plaintiff Mike Voeltz, amending and pursuing his existing complaint. “Mr. Voeltz exhaustively researched FL statutes and assembled a good complaint. We fine-tuned some of the arguments, developed legal strategies and also introduced more aspects of Obama document/identity fraud into the case. Sheriff Joe Arpaio’s report and previous investigators will help significantly. Settled natural born Citizenship law was already incorporated.”

Barnett disclosed that ConstitutionActionFund.org, Inc. is their resource to help finance ballot challenges in Florida, California and possibly more in the future in other states. This legal strategy to keep Obama out of the White House in 2013 depends upon contributions from citizens who believe that Obama is not a legal President under the Constitutional requirement to be a NATURAL Born Citizen and that he should not fraudulently appear on state ballots again in 2012. Per the ongoing Arpaio investigation in AZ, the birth certificate “Obama” claims to have showing his birth in Hawaii is likely fraudulent.

Dozens of federal and state eligibility cases were dismissed for various “standing” and jurisdiction technicalities after the election in 2008. More recently, several state ballot challenges have been initially dismissed, due to invalid vetting interpretations and misapplication of precedent law by the judiciary.

Asked whether he has the goods on Obama, Klayman exclaimed, “Of course! Others have already gathered what we need, with more in the pipeline. The task at hand is to compel court proof, official acknowledgment and removal from the ballot, as well as present the damning facts about Obama to the court of public opinion.” Asked what he’ll do to help succeed, he stated: “accurate reading of applicable law, attention to rules of evidence, researching case law, venue selection and use of ‘political theater’ out of court.” Case: Voeltz v. CHICAGO, Ill. – Did the parents of former Weather Underground terrorist Bill Ayers help finance Barack Obama’s Harvard education?

Did Ayers’ mother believe Obama was a foreign student?

And was the young Obama convinced at the time – long before he even entered politics – that he was going to become president of the United States?

A retired U.S. Postal Service carrier who delivered mail to Tom and Mary Ayers in a Chicago suburb in the late 1980s and early 1990s and claims to have met Obama in front of the Ayers home emphatically says yes to all three questions.

Allen Hulton, who was commended for 39 years of honorable service with the USPS, has given a sworn affidavit to investigators commissioned by Maricopa County, Ariz., Sheriff Joe Arpaio to determine whether Obama is eligible for Arizona’s 2012 election ballot. Hulton has recorded about three hours of video interviews with WND.

Hulton says that in conversations with Mary Ayers while on his route he learned of the couple’s enthusiasm and support for a black foreign student. One bright, warm Chicagoland day, he recounts, he met the student who fit Mary Ayers’ description in front of the Ayers home in Glen Ellyn, Ill. That young man, Hulton is convinced, was Barack Obama.

Hulton delivered mail to the Ayers, who are both deceased, when he was stationed at the post office in Glen Ellyn, an upper-middle class suburb 25 miles west of downtown Chicago, from late 1986 to 1997. He was a USPS employee from March 28, 1962, through March 30, 2001. (Editor’s note: Although the Ayers family no longer lives there, WND is withholding the Glen Ellyn street address for the sake of the current residents’ privacy.)

“It was a beautiful neighborhood – one of the nicer routes any of the letter carriers would have liked to have had,” Hulton recalls. “It had some large and very beautiful homes.”

As WND reported yesterday, Obama’s relationship with Bill Ayers – who he dismissed in a 2008 debate as “just a guy who lives in my neighborhood” – plagued him in the 2008 presidential campaign and could resurface in this year’s election, as many questions remain.

"Philip Berg, a Lafayette Hill lawyer who previously tried to take his claims about Obama's citizenship to the U.S. Supreme Court, lost his ballot challenge, which Commonwealth Court rejected at the request of John Lavelle Jr., Pennsylvania counsel for Obama for America.

The court, in a two-page order, said ballot challenges can be based on the authenticity of signatures on nominating petitions, the affidavits of the people who circulated those petitions, or the affidavits candidates file about their financial interests.

"The sole basis for the objection is [Berg's] contention that President Obama is not a 'natural-born citizen' eligible for the office of president of the United States under the United States Constitution," the ruling said, adding that Commonwealth Court does not have the jurisdiction to rule on Berg's claims.

Berg called the ruling "unconscionable" and said he was considering an appeal, either to the state Supreme Court or another try in federal court.

"As far as I'm concerned, he's a phony, he's a fraud, he's an impostor, and this is the biggest fraud perpetrated on the country in history," said Berg, repeating his claim that Obama was born in Kenya."

"Half of Americans are unconvinced that Barack Obama’s birth certificate, released in 2011 at the White House amidst fanfare and proclamation that it is “proof positive” of Obama’s eligibility to be president, is authentic.

The poll reveals that nearly 33 percent of the respondents say they do not believe Obama has “provided adequate and authentic documentation that he is qualified to serve as president.”

And another 14 percent say they are uncertain whether he has.

The numbers show 52.8 percent say Obama has provided that documentation.

The statistics are very nearly the same for related questions. While 54 percent said they believe Obama is eligible, 29.8 percent simply said that he is not. And another 16 percent had doubts about the issue enough that they could not ascertain that answer.

Also, while 50 percent say his long form birth certificate is real, 25 percent say it is a fake and 24 percent say they just can’t determine.

“Much has been written over the past three years about the Obama administration’s dismissive approach to the U.S. Constitution, but there is little as shocking as the findings of this latest survey that nearly half of the registered voters in American believe the president is not legally qualified to serve,” said Fritz Wenzel in his analysis of the results.

“Even among the most liberal Americans – his most ardent supporters – more than 20 percent said they think he is not eligible, yet there is no outrage or protests in the streets. There is simply no way to describe this situation because it is unlike any we have ever seen before,” he said.

“Politically, the findings on this subject spell potential disaster for the Obama re-election campaign in that one in three independent voters does not believe Obama has provided enough documentation to prove he is legally eligible to hold the presidency,” Wenzel said. “These people will not be voting for him.

“This is a substantial bloc of what we think to be swing voters to have taken off the table right from the beginning, and it spells political disaster for the White House.”

However, he noted that Obama is not the only one at fault."

"WND also reported that another recent poll showed half of registered voters would like to see Congress investigate Obama’s eligibility. It also showed nearly that many believe the definition of the constitutional term “natural born citizen” means both parents must be U.S. citizens.

At that time, Wenzel noted, “Even among Democrats, more than one in four – 28 percent – said they now want an inquiry, as do 43 percent of independents and 77 percent of Republicans.”"

"It reveals that almost 40 percent of Americans – that would be somewhere in the range of 130 million or 140 million or so – now think the nation is facing a constitutional crisis because of a lack of documentation regarding Obama’s eligibility.

The scientific telephone survey was conducted March 10-13 and has a margin of error of 3.72 percentage points.

The poll reveals that 25.8 percent of respondents say they strongly agree with the statement that the country now is facing a constitution crisis on the issue of an eligible president. Another 13.7 percent say they somewhat agree."

PHOENIX – Arizona officials have jumped back into the debunked birther controversy over President Barack Obama's birth certificate and his eligibility to hold office, endorsing a proposal that requires presidential candidates to swear that they meet the qualifications of the nation's highest office.

A legislative committee on Wednesday endorsed the proposal and the Arizona secretary of state is expected in the coming days to call for candidates to complete a new form asking eligibility questions, including whether they are natural-born U.S. citizens.

The widely-disproved notion that the president was born abroad rather than in Hawaii, as state officials have repeatedly confirmed, comes up regularly in Arizona. Most recently, the man known as "America's Toughest Sheriff", Maricopa County Sheriff Joe Arpaio, released a report from a volunteer posse challenging the authenticity of the president's birth certificate.

Forgerygate: Ignoring Arpaio's report is a scandal in itself

Is President Obama’s birth certificate a forgery? Sheriff Joe Arpaio of Maricopa County, Ariz., believes it is. He recently held a press conference in Phoenix to discuss the findings of a new 10-page report. Mr. Arpaio’s investigators have come to a stunning conclusion: The long-form birth certificate Mr. Obama released last year is a “computer-generated forgery.”

With the exception of The Washington Times, however, no major U.S. media outlet reported this bombshell story. The liberal press corps is desperately trying to suppress any discussion of Forgerygate — potentially one of the biggest scandals in American history. The media class is betraying its fundamental mission to pursue the truth.

“Based on all of the evidence presented and investigated, I cannot in good faith report to you that these documents are authentic,” Sheriff Arpaio said. “My investigators believe that the long-form birth certificate was manufactured electronically and that it did not originate in paper format as claimed by the White House.”

The Washington Times story, written by Stephen Dinan, points out that Mr. Arpaio has called for Congress to investigate the matter. Think about this: A high-profile sheriff orders a team of former law enforcement officials to examine whether the president is truly a natural born citizen and that he has the constitutional and legal right to occupy the White House. Their official report is that Mr. Obama’s documents are shoddy and he likely engaged in deliberate fraud. And yet, most of the American press corps doesn’t believe this is an important news story? The liberal media has become rotten to the core.

Ironically, the foreign press reported widely on the story. For example, Pravda — that’s right, the former official organ of the Soviet Communist Party — did an extensive analysis of Mr. Arpaio’s findings. The article by Dianna Cotter asks the obvious question: What are U.S. journalists afraid of?

The answer is that the issue strikes at the heart of Mr. Obama’s administration: If his presidency is illegal, then all of his accomplishments — the stimulus, Obamacare, the contraceptive mandate, the government takeover of the auto sector and appointments to the Supreme Court — are illegitimate as well. The scandal would trigger a constitutional crisis.

Following Mr. Obama’s surprise news conference last year, when he unveiled the long-form certificate, the media insisted that the controversy was settled once and for all. The "birthers" supposedly had been silenced. Mr. Arpaio’s report, however, changes that. The issue has been resuscitated — except in the eyes of the mainstream media.

A prominent sheriff says he has damning evidence that Mr. Obama probably lied to the public. The international media believes it’s a big deal; many Americans agree. They want to get to the bottom of it. Yet, the liberal hacks at the New York Times, the Washington Post, CNN and MSNBC can do nothing more than yawn.

Contrast this with their treatment of President George W. Bush. Throughout the Bush years it was open season: routine comparisons to Adolf Hitler, charges of being a war criminal, calls for impeachment, trumped-up scandals like the Valerie Plame affair, investigations into the partying habits of his teenage daughters, stories about Mr. Bush’s drinking as a younger man, his National Guard service and mediocre college grades — journalists left no stone unturned, no questions unanswered, no topic was beyond the pale.

Not with Mr. Obama. In fact, the opposite is true: Almost everything pertinent is not to be touched. He is the least-vetted president in modern memory. During the 2008 campaign, the liberal media deliberately propped up Mr. Obama. They suppressed vital information about his radical past and deep ties to virulent revolutionary leftists — the Rev. Jeremiah Wright, Bill Ayers, Bernardine Dohrn, Derrick Bell, Saul Alinsky and Edward Said. For all of their differences, they share one value in common: hatred for traditional America.

To this day, Mr. Obama’s college transcripts, undergraduate thesis and health records remain sealed. We know little about his years in Indonesia as a young boy; his overseas trips to countries like Pakistan in the 1980s; his relationship with his mother and Muslim stepfather; and his time spent as a “community organizer” in Chicago. In short, the president’s past is clouded in mystery. This is not conspiracy-mongering, but objective fact. Americans have a right to know who their commander-in-chief really is. Instead, the media wants to bury any debate or inquiry into Mr. Obama’s background.

A Tennessee man described as an Obama “fanatic” has been convicted of threatening to kill Arizona Sheriff Joe Arpaio and his family, possibly in connection with the lawman’s investigation into the president’s eligibility for office.

Adam Eugene Cox, 33, of Knoxville, was arrested Jan. 27 in connection with graphic online threats that came to light last October.

Cox’s threats included: “I plan to kill Arpaio first. He will be filled with a thousand bullet holes before the year is out. I promise you this. He won’t f**k with Obama. He will be buried 10 feet under and his whole family will be murdered along with him.”

Authorities say Cox’s postings indicate – and his own mother confirms – that Cox is a “fanatical supporter” of Obama, and Arpaio’s ongoing investigation into the legitimacy of the president’s purported birth certificate may have been the reason behind the threat to kill the sheriff.

FLASHBACK: Back in October of 2011 an Obot left numerous comments at this blog threatening to kill various people that have pursued Obama's ineligibility to be president. One comment was directed at Sheriff Joe and his family where the commenter posted the following:

"I plan to kill Joe Arpaio first.. He will be filled with a thousand bullet holes before the year is out., I promise you this. He won't fuck with Obama. He will be buried 10 feet under and his whole family will be murdered along with him. Don't like it? Come stop me. Come die before me."

Right after that comment was submitted we grabbed the IP address from the commenter and the location was in Tennessee. We then sent the pertinent information and the actual death threat to Dr. Corsi, among others, and informed them we were not 100% certain that was the commenter but we were pretty sure it was and it could be easily verified by contacting Blogger owner Google to confirm. Dr. Corsi later informed us that Sheriff Joe's office was now investigating the death threat.

Those who have read Politico in the past know that they are no friend to so-called “birthers”, much less conservatives and tea partiers. Just the other day, they attacked us again.

One of Politico’s minions, Alexander Burns, cleverly inserted a blatantly false comment in a piece he wrote about how voters don’t really seem to know much about the issues. Indeed, rather than debate us about our constitution and how it is at stake with this regime, we were also called “stupid.” Far-left Democratic pollster Tom Jensen of PPP (Public Policy Polling) had this to say:

The first lesson you learn as a pollster is that people are stupid…We’re seeing that kind of thing more and more. I think it’s a function of increased political polarization and voters just digging in their heels and refusing to consider the opposing facts once they’ve formed an opinion about something…I also think voters are showing a tendency to turn issues that should be factual or non-factual into opinions. If you show a Tennessee birther Obama’s birth certificate, they’re just going to say ‘well in my opinion he’s not a real American.’ It’s not about the birth certificate; it’s about expressing hatred for Obama in any form they can.”

What Mr. Jensen, Mr. Burns, and the rest of the idiots at Politico don’t get is that we Constitutionalists do not hate Obama just because of who he is. In fact, we don’t hate him, the person Barack Obama, at all. We just hate the fact that he is a pathological liar about nearly everything, from his birth certificate and educational background to his tenure in politics to his connections to unrepentent terrorists and other shady figures to his disastrous tenure as our president. This lie by the liberal media has been going on since Obama was first inaugurated; as you may remember, it started when they accused Rush Limbaugh of wanting Obama to fail when in fact Rush said that he wanted Obama’s socialist vision for the country to fail.

DIRTY LITTLE SECRET: Historical evidence provided by the National Center for Health Statistics and the U.S. Reference Library System now confirms the information appearing within the image of Obama’s alleged 1961 “Certificate of Live Birth” disregards his actual foreign birthplace while, instead, providing a statistically based “geographic allocation” which is a result of a widely misunderstood natality data reporting policy which began in 1950. Stalling for four years since Obama announced his candidacy in February of 2007, under mounting political pressures and legal challenges, the White House unveiled a lone scrap of counterfeit information in the form of a desolate internet image which, after a six month criminal investigation, now confirms that Obama’s presidency is the single greatest hoax ever perpetrated on the American people.

NEW YORK, NY – Barack Obama has misled millions into believing he is eligible to hold the office of the U.S. presidency by exploiting a little known secret about his Hawaiian-based natal records which were issued in conjunction with a commonly used, but publicly misunderstood, vital statistics reporting anomaly used to allocate birthplace according to residency by the State of Hawaii in 1961.

Following a six month investigation by an Arizona-based law enforcement agency proving that the image of Barack Obama’s alleged 1961 “Certificate of Live Birth” is a digitally fabricated forgery, it has now been confirmed that the information contained in the document, which claims he was born in the state of Hawaii, is nothing more than the result of a widely misunderstood statistical reporting trick.

As early as 1934, this arbitrary, but necessary method was enacted by the U.S. Census Bureau and later written into law with the passage of the Model State Vital Statistics Act of 1942. It was then fully adopted by all state-level vital records agencies, including those within the then territory of Hawaii, in 1950 in order to improve the collaborative accuracy of data harvested by America’s decadal census and statistics reported annually by state vital records agencies.

Though commonly practiced by vital records data collection agencies of federal and state governments as a means of defining “residency” in birth data reporting, the policy completely disqualifies birth records as the only source of information about a candidate to determine Natural-born eligibility to hold the office of the presidency.

The birthplace shown on a birth certificate is entered as the result of the mother’s place of residence, not the location of the occurrence of the birth.

The truth about this information is so damning to Obama’s fraudulent assertions of presidential eligibility, counterfeiters and leftist propagandists operating on behalf the liberal establishment chose to digitally fabricate, conceal and misrepresent these critical facts prior to submitting public information about Obama’s natal history.

CONSTITUTIONALLY DISQUALIFIED BY MISALLOCATION OF BIRTHPLACE

As discussed previously in parts one and two of this report, the combination of Hawaii’s unique culture, isolated geographic characteristics, unfettered immigration policy and municipal development challenges in the 1960s prompted the use of vital records registration protocols by the State of Hawaii’s Department of Health which undermine the reliability of birth certificate information as a means of determining the natural-born citizenship of any individual.

However, it is now clear that Obama exploited the existence of a widely misunderstood natal data reporting method implemented by the federal government, 11 years before his birth certificate was issued, based on an arbitrary statistical application which classifies the actual place of birth by allocating it as occurring in the same location as the mother’s “place of residence”. This allocation is made regardless of the actual location of the birth because the data provided about the birth to the Census Bureau is used for calculating the impact of natality on resident population and, therefore, must be recorded by the registrar using the same criteria used to count those defined as residents by the Census.

The allocation of births to “place of residence” protocol was implemented sporadically beginning in 1935 to provide for statistical integrity between decadal Census data collection and more frequently collected natality rates taken from real-time birth registrations. Prior to the implementation of the policy, the accumulative affect of non-resident and foreign birth statistics on U.S. birth volumes caused a skewing of natality rates when compared to Census population rate data. These errors had to be corrected in order to use the data for accurately measuring resources in developing public health services, municipal infrastructure and women’s reproductive health research.

Between 1937 and 1949, the NCHS published the annual version of its statistical reporting manuals containing a section called “Vital Statistics of the U.S., Part II Geographic Classification By Place of Residence” which explains, among many other arbitrary rules, the reasoning and methods used to show natal statistics for foreign-born children of U.S. resident mothers.

The manuals repetitively explain that the tabulation of vital statistics taken from birth certificates, on a “place-of-residence” basis, requires that the information given on the certificate must be allowed “to be interpreted in such a way” as to afford statistical classifications of birth geography used to calculate natality rates which are comparable with statistical classifications of population geography used to account census data.

This means the Hawaiian registrar was/is directed to record the place of birth as being the same as the mother's place of residence, regardless of where it actually occurred. This explains why Obama’s alleged 1961 “Certificate of Live Birth” states that his birthplace was in Hawaii even though he was not likely born there. His birth affected the population of the community where his mother lived, not where she gave birth to him.
