This is just more proof that that garbage posted at FactCheck.org is a big fat FAIL. It must be noted that the sealless/numberless COLB posted at Obama's FightTheSmears.com website is a much different COLB than what is posted at the FactCheck.org website, and it too is a big fat FAIL. It is also important to note here and here that the Hawaii DoH refuses to back-up any one of the Obama COLB's. Now you know why! The question remains; WHAT ARE YOU WAITING FOR, MEDIA HACKS!? -snip-
At long last. A copy of the Hawaii Department of Health seal has been disclosed by the department directly. And it’s a doozy.
A records request made under the Uniform Information Practices Act (UIPA), Hawaii’s Open Records law, for a black and white copy of the Hawaii Department of Health’s (HDOH) departmental seal as described as “Exhibit A” in their agency administrative rules has yielded disclosure of an electronic copy of the Department’s embossed seal. I have posted it for download and viewing at the end of this post. But let me preface with a suggestion: sit in a stable chair, get a drink (not coffee), and take a DEEP breath. Although I am still waiting for disclosure of “Exhibit A” (a black and white illustration version of the Department’s seal) it is my opinion that this image of an embossed version (a version the HDOH chose to substitute on their own and provide to me without my express request) is definitely worth sharing despite having some quality issues.
While there is a story unfolding concerning the HDOH’s irregular action and response to my request for disclosure of “Exhibit A” that I will relay in the near future, I am restricting this particular post to the introduction of the image they did provide me and to offer some background on why it was requested and why it appears in ‘Obama’s Garden.’ What I will say for now though is that the HDOH appears to be very reluctant to release the specific record authorized by law to be disclosed to me considering they first denied my request, then conceded after consulting with the Office of Information Practices (OIP) that disclosure is authorized by state law, then failed twice to provide me the specific record I requested. Still, this newly disclosed image represents major progress coming from such a demonstrable and historically closed agency. It may have been difficult for me to visually imagine how a black and white illustration of the seal would translate into an embossed image for use in certifying, so I thank the HDOH for sparing me that exercise.
Some Background
Recently, I have been corresponding with the HDOH and OIP on several past and new UIPA requests and requests for guidance. Again, there is more on this to come and it will show the seal is only the tip of the iceberg. But, I have stepped up my efforts at researching President Obama’s birth narrative and the controversy surrounding his vital records after noticing and speaking out about peculiarities in other researchers’ work and anomalies in other Certifications and Certificates of Live Birth found online. These online versions of Certifications and Certificates of Live Birth are used constantly by researchers on all sides of this controversy in an effort to determine what the uniform practices are at the HDOH. In other words, in reference to these online images, people have made determinations about the validity of the information found in President Obama’s online image of a Certification of Live Birth – including the embossed department seal.
It is because of my observations and my resulting suspicions that I began to look at the laws that make up the UIPA with fresh eyes.
One new discovery is that agency administrative rules alone cannot restrict nor prohibit disclosure of records requested under the UIPA. This important realization led to my successful UIPA request authorizing disclosure of ‘Exhibit A’ and led to the direct disclosure of an image of the embossed version of the department’s seal. For the most part, I no longer have to wonder if a seal seen in an anonymous image online is credible to use as visual reference. Because as it turns out, most are not. On that note, other legal epiphanies center around laws allowing an individual to verify some of those ‘mostly’ anonymous COLBs presented online, and therefore in the public domain, as representative of authentic HDOH issued certified copies of birth records. More on that later, too.
However, despite the major progress made – I am left scratching my head and wondering:
Why do President Obama’s ‘Certification of Live Birth’ and so many of the online images of alleged certified copies of Hawaiian Certificates of Live Birth and Certifications of Live Birth bear Hawaii Department of Health embossed seals that are completely inconsistent with the image directly released by the department and in effect since 1988?
It’s true. The HDOH released an image of their embossed seal and it is clearly inconsistent with every online image of an alleged HDOH embossed seal having any clarity that I have seen. Although I admittedly have my own theories as to what’s going on, theories I am working on proving, I will leave it to you to decide what, if anything, it all means. One thing I will say is that I do not have confidence in any online image of a Certificate or Certification of Live Birth allegedly issued from Hawaii bearing a seal that is entirely inconsistent with what the department provided me and what they are authorized to provide to ANY person requesting a copy under the UIPA–including yourself. No reasonable person should ask or expect me to.
For anyone questioning my stance or my motives, kittycat, I urge you to request your own image of an embossed seal or ‘Exhibit A’ black and white illustration. Or consider that I offer nothing to substantiate the COLB that Obama issued. I cannot. Whether I am liberal or conservative, a document forensic expert or not–I have eyes that see something isn’t right. Style anomalies, like differing typefaces, are not dependent on my political views, or unfamiliarity with how to conduct this type of research, or how to diplomatically comment online without hurting feelings or how to blog about my observations. I just want the truth and will step out of my comfort zone to find it. If that ruffles a few feathers, so be it. I am going with what the HDOH provided me, not what an anonymous freeper or self-professed document forensics expert or anyone else provided online. And any claims that in 2007, the HDOH had a ‘special’ seal are BOGUS. The same image has been used for 22+ years. In my opinion, flimsy evidence of a ‘forgery’ happens to be convenient corroboration and provides a useful distraction. If this opinion makes you uncomfortable, ah well. Our uninterested, unethical media left me no choice but to fumble my way through this. BTW, if you are someone who put your ‘own’ COLB online or offered it up as credible research material, you waived your privacy (if you had any) where Hawaii law is concerned–so be sure to redact information that could allow someone to verify your image is phony. A name is not the only method of locating a certificate on file at the HDOH and disclosure of information is not necessarily dependent on the registrant’s direct approval.
The Seal
Here it is. You may download the pdf provided to me directly by the HDOH through the use of the UIPA here and below is a jpeg version I extracted from that pdf. For quick comparison, I have provided a couple of graphics using the seal and close-ups of the seal found on President Obama’s Certification of Live Birth taken from photos published by Factcheck. I noted only a few of the MANY anomalies myself. Comparisons to other alleged online Hawaii COLBs through Google image search is recommended for those interested. And isn’t it just typical that we can’t get CNN, MSNBC, or Fox News to report on the fact that the President of the United States has a ‘birth certificate’ with a department embossed seal bearing no resemblance to one directly disclosed through Open Records Law in light of the ongoing controversy. Yuck.
Anyway, happy sleuthing to you guys – the ‘acting’ media in their utter absence. And hopefully, I will have more to share soon.

Dr. Fukino has authority over only one image, and it is the one they provided me and is described & attached to the agency administrative rules as ‘Exhibit A.’
FACTS:
• Typeface is a significant identifying feature of the seal. Obama’s is wide and bold, the HDOH seal lettering is condensed and a much lighter weight.
• Present is a type treatment anomaly seen in the word ‘OF.’
• Two stars are missing but described in those administration rules.
Due to these indisputable facts, the seal on Obama’s COLB is not the HDOH seal and Dr. Fukino does not have authority over the seal appearing on Obama’s COLB according to the description in the Title 11 rules AND the version disclosed in my records request. The seal seen on Obama’s COLB HAS NO LEGAL WEIGHT either online or as a physical copy.
Furthermore, agency rules are rightly called ‘regulations’ in that they make the operations and administrative practices UNIFORM. See the Chapter on Rulemaking from the Hawaii Revised Statutes, this one in particular:
Ҥ91-2 Public information. (a) In addition to other rulemaking requirements imposed by law, each agency shall:
(2) Adopt rules of practice, setting forth the nature and requirements of all formal and informal procedures available, and including a description of all forms and instructions used by the agency.”
Obama’s seal is not uniform to the seal described in the Title 11 Administrative Rules but the one supplied to me directly by the HDOH is.
Also worth noting is that only the Director of the Department of Health may issue a certified copy of a vital record. Therefore, all seals on all certified copies since 1988 should be uniform.
There is no room for debate. Arm yourself with this info, so you can let the Obots and Obot plants know they have no leg to stand on.

I have a friend who lives in Hawaii and I have PERSONALLY SEEN his BC -- The seal on his is the EXACT same as is on Obama's BC. Why do you birthers keep pulling stuff out of your behind?

They wrote this in the body of the email with the image attached: “Based on your request, we provide you with a copy of the Department of Health seal as described in HAR §11-1-2; this seal is an embossment.”
They named the file they provided: 'embossed-seal.pdf.'
For reference: this is what HAR §11-1-2 says:

It appears to me that someone rubbed the impression of the seal with pencil, or something similar, to enhance the image for copying. Because according to the HDOH, it is an embossment, obot jerk-offs.
