As a Plaintiff sitting in the front of the courtroom on January 26th, 2012, I had a very unique vantage point from which to experience the day’s proceedings as they unfolded in the momentous Georgia Ballot Challenge hearing in Atlanta. However, in the days preceding the hearing; a flurry of activities transpired and in this update I will share a few of them from a first hand perspective. I intend to publish a comprehensive chronological account in meticulous detail, although for now on the eve of Judge Malihi’s findings of fact and law I give you these:

6 am I went to U.S. Customs and Immigration Service Atlanta Field Office.Received an email from Tom Terry of Terry v. Handel and he sent me all of his records of the different Certificate of Nominations from 2004 and 2008.
While I was at the Georgia Archives I got a phone call from Attorney Mark Hatfield telling me the huge news that Malihi denied Jablonski’s Motion to Quash subpoenas!

Called Ken Allen and found out he was able to reschedule and will fly to Atlanta for the hearing.Went to Georgia Archives and searched Georgia Elections Records from 1888 – 1976.
Found Certificate of Nomination for President Coolidge.
August 28th 1924 letter from Republican National Committee to Secretary of State:
“Kindly acknowledge receipt of this certificate and indicate to me whether there are any requirements of the statutes with reference to the placing on the ballots in your state the names of President Coolidge and General Laws, which have not been complied with.”

Even though Calvin Coolidge had succeeded Warren Harding as President in 1923, this letter shows the Republican National Committee asking the Secretary of State if he was in compliance with the law when seeking Ballot access in Georgia while President of the United States.”

The judge waiting on this decision has no bearing on how many more days Obama will be in the WH. No matter what Malihi decides, Obama WILL finish his remaining term. This case isn't about removing him from the WH. It's about preventing him from getting back in 2012.
It does matter you idiot. If obama isn't eligible to be on the 2012 ballot that means he wasn't eligible to be on the 2008 ballot. Article 200 section 3 of the constitution says the president elect must be eligible.

The case is a HEARING before an administrative judge who has exactly zero powers in this issue other than to make a recommendation to the SoS.
The case is about whether Obama meets the requirements to be on the (uncontested) DNC ballot in Georgia RIGHT NOW.
The actual lawyers, as opposed to Orly, were very specific that their cases were ONLY about this and only this ballot access.
The administrative judge can only make a reccomendation on that which has been argued, i.e. access to the DNC ballot, no less and certainly no more
The case has nothing to do with the current presidency and CANNOT have anything to do with it as the powers to impeach are reserved to Congress and only Congress.
Oh and don't forget, no matter what the result is, all it does at most, is say Obama cannot be on the DNC ballot in Georgia.
It has exactly zero effect on the election for President as at that point that will be a Federal issue and the State of Georgia has exactly zero powers and authorities to bar a candidate from Federal office.

He never said yesterday was the deadline for him to make his recommendation to the SoS. Yesterday was the deadline for submission of findings and conclusions by the attorneys.
There is no deadline for him to submit his recommendation, though it will most likely be in the next day or two. He does have other maters on his calender as well.

Obama cannot get to first base and argue that he is a natural born citizen based on a jus soli birth, which is really BS. His lack of evidential submission to the court to where he was born in the United States is tantamount of Obama being foreign born. Therefore, dumb OBots, the recommendation will be to the SoS that Obama be kicked off the Georgia state ballot. The Georgia Secretary of State will highly likely go with the court's recommendation. And you will lose OBots on the facts and merits of the case.

Obama doesn't have to submit anything at this point. van Irion and Hatfield submitted Obama's BC and stipulated to its authenticity when they used it to bolster their "two-parents NBC" theory.

Whatever you've heard, Redd, it didn't come from the judge. I wouldn't rely on the grapevine, especially if Orly and Carl and David are the grapevine gossips. Past experience has shown that Orly misinterprets whatever she's been advised. Remember when she "heard" Judge Carter granted her discovery and she proceeded to announce that she would have Obama out of office in 30 days? That was 9/12/2009.

I'm an criminal law attorney in California...if things get really ugly, I would assume that Obama could raise the constitutional protection of ineffective assistance of counsel (re: Jablonski) and get a new hearing or trial? I don't know admin hearings well enough to say for sure.
Is there any record of Jablonski saying that this was Obama's decision?

Now, real slow, so you can work through it....When the lawyers submitted images/copies of Obama's BC to the court as evidence of birth and it its not disputed, guess what, the court accepts it as evidence for the purposes of the hearing....oops.
So, the judge has had it stipulated, by counsel, without objection, that they accept the facts of birth as shown in the documents presented into evidence.
Now, Malahi COULD try and buy into the whole "2 parent" thing, but guess what, as I already told you all he can do is make a recommendation to the SoS, which has no force in law, who will make the call.
As I also told you, it makes not one iota of difference even if the SoS does say to bar Obama from the DNC ballot in Georgia.
Obama will STILL be the Democratic party candidate for the Presidency and Georgia CANNOT keep him of a FEDERAL ballot.
The tears and gnashing of teeth will be interesting to watch.

FYI,
A default judgment is usally a forgone conclusion when a defendant or plaintiff fails to appear in court.
Especially if the defendant or plaintiff fails to appear after having been explicitly warned about the perilious nature of making such a foolish decision!
Therefore, I don't think the "slam dunk" predictions that we have been seeing with regard to these hearings are are at all unlikely to occur.
They just might not materialize quite as quickly as we had hoped they would.
Forget being on the ballot. Criminal charges must be filed against Soetoro.

A Georgia judge has rejected a complaint that sought to keep President Barack Obama off the state's ballot for next month's presidential primary.
Deputy Chief Judge Michael Malihi filed his decision Friday. The complaint contended Obama isn't a natural-born U.S. citizen and therefore should not be on the state's ballot. Malihi said in his decision that it has been determined that Obama was born in the U.S.
Similar complaints have been filed in other states with no success.
Obama's local attorney Michael Jablonski did not attend a hearing last week in Atlanta. Plaintiff's attorneys urged Malihi to hold him and the president in contempt. The judge said in his decision he doesn't condone Jablonski's conduct but did not hold him or the president in contempt.
WHAT A DISGRACE TO THE RULE OF LAW!
