Found Certificate of Nomination for President Coolidge.

August 28th 1924 letter from Republican National Committee to Secretary of State:

“Kindly acknowledge receipt of this certificate and indicate to me whether there are any requirements of the statutes with reference to the placing on the ballots in your state the names of President Coolidge and General Laws, which have not been complied with.”

Even though Calvin Coolidge had succeeded Warren Harding as President in 1923, this letter shows the Republican National Committee asking the Secretary of State if he was in compliance with the law when seeking Ballot access in Georgia while President of the United States.”

CITATION FOR CONTEMPT

Now come Plaintiffs Carl Swensson and Kevin Richard Powell, by and through undersigned counsel, and move the Court, pursuant to O.C.G.A. § 50-13-13(b) and OSAH Rule 616-1-2-.22 (5), to certify to the Superior Court of Fulton County certain facts, relative to the contemptuous behavior of the Defendant before this Court, for a determination of appropriate action, including a finding of contempt, In support of this Citation For Contempt, Plaintiffs show to the Court the following facts-:

1. On or about January 19, 2012, undersigned counsel for Plaintiffs served upon defense counsel a "Notice to Produce," requiring Defendant Barack Obama to appear at the January 26, 2012 trial of this matter and to bring with him into Court certain documents and other items to be used as evidence by the Plaintiffs at trial,

2. Defense counsel made no response to Plaintiffs' Notice to Produce-. Defense counsel filed no motion for protective order, motion to quash the Notice to Produce, or any other pleading objecting to the Notice to Produce,

3. Despite being timely served with the aforesaid Notice to Produce, Defendant Obama failed to appear for the trial of these matters on January 26, 2012. Likewise, Defendant's attorney also failed to appear for trial- None of the documents or other evidence sought by Plaintiffs was produced as required by Plaintiffs' Notice to Produce.

4. The failure of Defendant Obama (and defense counsel) to appear for trial on January 26, 2012 was knowing, intentional, and deliberate, as demonstrated by Plaintiffs' Exhibit 12, a January 25, 2012 letter written by defense counsel to Georgia Secretary of State Brian Kemp.

5. Defendant Obama's behavior in failing to comply with Plaintiffs' Notice to. Produce, by appearing for trial with the requested documentary and other evidence demonstrates Defendant's contempt for this Court and for the judiciary generally- OSAB _Rule 616-1-2-,22 (5) provides, in pertinent part, that the Administrative Law Judge, upon application of a party, shall certify the facts to the superior court the county in which a party, agent, or employee of a party: disobeys or resists any lawful order or process; neglects to produce, after having been ordered to do so, any pertinent book, paper, or document; or refuses to appear after having been subpoenaed, for a determination of the appropriate action, including a finding of contempt.

7. Plaintiffs hereby request that this Court certify the foregoing facts to the Superior Court of Fulton County for a determination of the appropriate action to be taken with regard to Defendant's contemptuous conduct.

DECISION

Plaintiff David Welden challenges Defendant Barack Obama‟s qualifications to run for the office of President of the United States. The Plaintiff presented evidence and argument on January 26, 2012, and the record was closed on that day.

Introduction and Findings of Fact

The Defendant‟s father was not a U.S. citizen at the time the Defendant was born. Defendant‟s father was a non-immigrant student at the time of the Defendant‟s birth. Pursuant to Article II of the United States Constitution, “No person except a natural born citizen…shall be eligible to the office of President.” U.S. Const. art. II, §1, ¶5. Plaintiff contends that the term “natural born citizen” means born in the United States of parents that were themselves United States Citizens. Defendant has presented no argument on the substance of the issue at hand.

A suburban Democratic candidate for Congress is ineligible to hold that office because he hasn't been a U.S. citizen long enough, records show.

Aloys Rutagwibira, 53, of Hainesville, is a native of Rwanda who became a naturalized American citizen on July 6, 2006, according to voter registration records acquired by the Daily Herald.

Congressional service requires seven years of citizenship. Rutagwibira won't be eligible until July 2013.

Rutagwibira is one of five candidates seeking the Democratic nomination for the 10th District seat now held by Republican Bob Dold.

Rutagwibira has not returned multiple telephone calls requesting interviews. He also failed to attend a scheduled candidate interview session Tuesday at the Daily Herald office in Libertyville.

When asked via email about his citizenship, Rutagwibira refused to confirm the date he took the citizenship oath.

Well, the press is still interested in enforcing Article I Section 2 of the U.S. Constitution as to who can serve as a U.S. Representative, but when are they going to start enforcing Article II Section 1 of the U.S. Constitution as to who can serve as the President and Commander in Chief instead of giving the current usurper resident of the White House a continuing pass. The Dirty “little” Secret Of The Natural Born Citizen Clause Revealed

I have emphasized the word “little” because the truth of the law on this issue is very simple, folks. So simple that the mystery is deciphered by application of one of the most clear, concise and undeniable rules of law; the code of statutory construction governs, and therefore, “natural born Citizen” must require something more than being born in the United States.

Let me put it to you in appropriately simple language:

Clause A = “Only a natural born Citizen may be President.”

Clause B = “Anyone born in the United States is a Citizen.”

(While these two clauses reflect Article 2, Section 1, and the 14th Amendment, I shall refer to them as “Clause A” and “Clause B” for now.)

The code of statutory construction is learned by every student in law school, and every practicing attorney has confronted it. Every judge is required to apply the rule equally to all statutes, and the Constitution. There is no wiggle room at all. The rule states that when a court examines two clauses, unless Congress has made it clear that one clause repeals the other, the court must observe a separate legal effect for each. More specifically, regardless of the chronology of enactment, the general clause can never govern the specific.

Clause B is a general rule of citizenship, which states that all persons born in the country are members of the nation.

Clause A is a specific clause that says only those members of the nation who are “natural born” may be President.

According to the rule of statutory construction, the court must determine that Clause A requires something more than Clause B.

It’s truly that simple. This is not some crazy conspiracy theory. It’s not controversial. This is not rocket science. Every single attorney reading this right now knows, beyond any shadow of a doubt, that I have accurately explained the rule of statutory construction to you. Any attorney who denies this rule, is lying. The rule cannot be denied. And its simplicity cannot be ignored.

Now let’s see what the United States Supreme Court has to say about the rule:

“Where there is no clear intention otherwise, a specific statute will not be controlled or nullified by a general one, regardless of the priority of enactment. See, e. g., Bulova Watch Co. v. United States, 365 U.S. 753, 758 (1961); Rodgers v. United States, 185 U.S. 83, 87 -89 (1902).

The courts are not at liberty to pick and choose among congressional enactments, and when two statutes are capable of co-existence, it is the duty of the courts, absent a clearly expressed congressional intention to the contrary, to regard each as effective. “When there are two acts upon the same subject, the rule is to give effect to both if possible . . . The intention of the legislature to repeal `must be clear and manifest.’ ” United States v. Borden Co., 308 U.S. 188, 198 (1939).” Morton v. Mancari, 417 U.S. 535, 550-551 (1974).

This is what I mean by no wiggle room – “The courts are not at liberty to pick and choose among congressional enactments…” Any court construing Clause A is not at liberty to assume that Congress intended to put the words “natural born” into Clause B. The general does not govern the specific, and the rule requires the court to “give effect to both if possible”.

Is it possible to give separate effect to both Clause A and Clause B?

Back in October of 2011 an Obot left numerous comments at this blog threatening to kill various people that have pursued Obama's ineligibility to be president. One comment was directed at Sheriff Joe and his family where the commenter posted the following:

"I plan to kill Joe Arpaio first.. He will be filled with a thousand bullet holes before the year is out., I promise you this. He won't fuck with Obama. He will be buried 10 feet under and his whole family will be murdered along with him. Don't like it? Come stop me. Come die before me."

Right after that comment was submitted we grabbed the IP address from the commenter and the location was in Tennessee. We then sent the pertinent information and the actual death threat to Dr. Corsi, among others, and informed them we were not 100% certain that was the commenter but we were pretty sure it was and it could be easily verified by contacting Blogger owner Google to confirm. Dr. Corsi later informed us that Sheriff Joe's office was now investigating the death threat.

Arrest made in death threat to Arpaio

PHOENIX -- A 33-year-old man in Phoenix has been arrested for threatening to kill Sheriff Joe Arpaio and his family.

Deputies in Knoxville, Tennessee worked with Maricopa County Sheriff's deputies to serve a search warrant and seize a computer and other evidence from the home of Adam Eugene Cox.

The investigation into an internet death threat started in October, and Cox was arrested Friday on an unrelated warrant for assault. He is now being investigated in the internet death threat of MCSO Sheriff Joe Arpaio and his family. Deputies obtained a search warrant at Google, where they were then connected to Cox.

His threat reads in part: I plan to kill Arpaio first. He will be filled with a thousand bullet holes before the year is out. I promise you this. He won't f**k with Obama. He will be buried 10 feet under and his whole family will be murdered along with him.

The threat comes in response to the Sheriff's office's investigation into the legitimacy of Obama's birth certificate. Cox's mother confirmed with police that he is an avid supporter of president Obama and police say he has a history of assault.

As we are trying to get a quick lunch, and then do some interviews, this is just a very brief synopsis of what happened today. Before the hearing started, the judge called the attorneys into his chambers and explained that he was going to enter a default judgment in their favor. Attorneys Hatfield and Irion requested to be able to present abbreviated versions of their arguments so that they would be on the record. At that point, Irion estimated he would need 20 minutes, Hatfield estimated he would need 30 minutes, and Taitz estimated she would need 2 hours.

Van Irion and Mark Hatfield made their arguments, and left. Taitz then presented her argument, calling several witnesses, until the judge asked her to make her closing statement. As her closing statement began, the judge asked if she was testifying, and, in an unconventional move, Taitz took the witness stand to testify. The judge finally asked her just to make her closing statement, which she did.

We believe that the default judgment automatically translates into the judge's recommendation to the Sec. Of State being that Obama should not appear on the ballot in Georgia.

The Judge pulled the lawyers for the three cases into chambers before it all began and advised them that he would be issuing a default judgment in our favor, since the Defense council failed to show, and wanted to end it there. We argued that all the evidence needed to be entered in to record so the Judge allowed for a speedy hearing where all evidence was entered into the court record. What that means is this… Any appeal, if one is even possible, would be based on the evidence provided by the lawyers in each case. Both Van Irion and My lawyer, Mark Hatfield made certain that our cases and evidence in those two cases would be closed so as not to be affiliated, in any way, with “Birther” Orly Taitz. As expected, she was an embarrassment.

Now we’re merely awaiting the publishing of this Judge’s ruling which, as previously stated, will be a Default Judgment. - Carl

A political action committee which believes Barack Obama is not legally qualified for U.S. president plans a live broadcast of tomorrow’s hotly anticipated court hearing in Atlanta regarding Obama’s eligibility.

The Article II Super PAC says it will provide uncensored, gavel-to-gavel video coverage of the event beginning at 9 a.m. Eastern at this online address.

Based in Simi Valley, Calif., the PAC says it decided to act out of a sense of frustration, since most national news outlets have been ignoring the constitutional mandate that presidents be a “natural-born citizen,” which the PAC maintains is a person who is a child of two U.S. citizen parents.

Dear Mr. Jablonski:

I received your letter expressing your concerns with the manner in which the Office of State Administrative Hearings ("OSAH") has handled the candidate challenges involving your client and advising me that you and your client will "suspend" participation in the administrative proceeding. While I regret that you do not feel that the proceedings are appropriate, my referral of this matter to an administrative law judge at OSAH was in keeping with Georgia law, and specifically O.C.G.A. § 21-2-5.

As you are aware, OSAH Rule 616-1-2-.17 cited in your letter only applies to parties to a hearing. As the referring agency, the Secretary of State's Office is not a party to the candidate challenge hearings scheduled for tomorrow. To the extent a request to withdraw the case referral is procedurally available, I do not believe such a request would be judicious given the hearing is set for tomorrow morning.

In following the procedures set forth in the Georgia Election Code, I expect the administrative law judge to report his findings to me after his full consideration of the evidence and law. Upon receipt of the report, I will fully and fairly review the entire record and initial decision of the administrative law judge. Anything you and your client place in the record in response to the challenge will be beneficial to my review of the initial decision; however, if you and your client choose to suspend your participation in the OSAH proceedings, please understand that you do so at your own peril.

Dear Secretary Kemp:

This is to advise you of serious problems that have developed in the conduct of the hearings pending before the Office of State Administrative Hearings. At issue in these hearings are challenges that allege that President Obama is not eligible to hold or run for re-election to his office, on the now wholly discredited theory that he does not meet the citizenship requirements. As you know, such allegations have been the subject of numerous judicial proceedings around the country, all of which have concluded that they were baseless and, in some instances – including in the State of Georgia - that those bringing the challenges have engaged in sanctionable abuse of our legal process.

Nonetheless, the Administrative Law Judge has exercised no control whatsoever over this proceeding, and it threatens to degenerate into a pure forum for political posturing to the detriment of the reputation of the State and your Office. Rather than bring this matter to a rapid conclusion, the ALJ has insisted on agreeing to a day of hearings, and on the full participation of the President in his capacity as a candidate. Only last week, he denied a Motion to Quash a subpoena he approved on the request of plaintiff’s counsel for the personal appearance of the President at the hearing, now scheduled for January 26.

For these reasons, and as discussed briefly below, you should bring an end to this baseless, costly and unproductive hearing by withdrawing the original hearing request as improvidently issued.

It is well established that there is no legitimate issue here—a conclusion validated time and again by courts around the country. The State of Hawaii produced official records documenting birth there; the President made documents available to the general public by placing them on his website. “Under the United States Constitution, a public record of a state is required to be given ‘full faith and credit’ by all other states in the country. Even if a state were to require its election officials for the first time ever to receive a ‘birth certificate’ as a requirement for a federal candidate’s ballot placement, a document certified by another state, such as a ‘short form’ birth certificate, or the certified long form, would be required to be accepted by all states under the ‘full faith and credit’ clause of the United States Constitution.” Maskell, “Qualifications for President and the “Natural Born” Citizenship Eligibility Requirement,” Congressional Research Service (November 14, 2011), p.41.

Nonetheless, the ALJ has decided, for whatever reason, to lend assistance through his office—and by extension, yours—to the political and legally groundless tactics of the plaintiffs. One of the attorneys for the plaintiffs has downloaded form subpoenas which she tried to serve around the country. Plaintiff’s attorney sent subpoenas seeking to force attendance by an office machine salesman in Seattle; seeking to force the United States Attorney to bring an unnamed “Custodian of Records Department of Homeland Security” to attend the hearing with immunization records; and asking the same U.S. Attorney to bring the same records allegedly possessed by “Custodian of Records of U.S. Citizenship and Immigration Services.” She served subpoenas attempting to compel the production of documents and the attendance of Susan Daniels and John Daniels, both apparently out of state witnesses, regarding Social Security records. She is seeking to compel the Director of Health for the State of Hawaii to bring to Atlanta the “original typewritten 1961 birth certificate #10641 for Barack Obama, II, issued 08.08.1961 by Dr. David Sinclair…,” even though Hawaii courts had dismissed with prejudice the last attempt to force release of confidential records on November 9, 2011. Taitz v. Fuddy, CA No. 11-1-1731-08 RAN.

In Rhodes v. McDonald, 670 F. Supp. 2d 1363, 1365 (USDC MD GA, 2009), Judge Clay Land wrote this of plaintiff’s attorney:

When a lawyer files complaints and motions without a reasonable basis for believing that they are supported by existing law or a modification or extension of existing law, that lawyer abuses her privilege to practice law. When a lawyer uses the courts as a platform for political agenda disconnected from any legitimate legal cause of action, that lawyer abuses her privilege to practice law….

As a national leader in the so-called ‘birther movement,’ Plaintiff’s counsel has attempted to use litigation to provide the ‘legal foundation’ for her political agenda. She seeks to use the Court’s power to compel discovery in her efforts force the President to produce a ‘birth certificate’ that is satisfactory to herself and her followers.” 670 F. Supp. 2d at 1366.

All issues were presented to your hearing officer—the clear-cut decision to be on the merits, and the flagrantly unethical and unprofessional conduct of counsel—and he has allowed the plaintiffs’ counsel to run amok. He has not even addressed these issues—choosing to ignore them. Perhaps he is aware that there is no credible response; perhaps he appreciates that the very demand made of his office—that it address constitutional issues—is by law not within its authority. See, for example, Flint River Mills v. Henry, 234 Ga. 385, 216 S.E.2d 895 (1975); Ga. Comp. R. & Regs. r. 616-1-2-.22(3).

The Secretary of State should withdraw the hearing request as being improvidently issued. A referring agency may withdraw the request at any time. Ga. Comp. R. & Regs. r. 616-1-2-.17(1). Indeed, regardless of the collapse of proceedings before the ALJ, the original hearing request was defective as a matter of law. Terry v. Handel, 08cv158774S (Superior Court Fulton County, 2008), appeal dismissed, No. S09D0284 (Ga. Supreme Court), reconsideration denied, No. S09A1373. (“The Secretary of State of Georgia is not given any authority that is discretionary nor any that is mandatory to refuse to allow someone to be listed as a candidate for President by a political party because she believes that the candidate might not be qualified.”) Similarly, no law gives the Secretary of State authority to determine the qualifications of someone named by a political party to be on the Presidential Preference Primary ballot. Your duty is determined by the statutory requirement that the Executive Committee of a political party name presidential preference primary candidates. O.C.G.A. § 21-2-193. Consequently, the attempt to hold hearings on qualifications which you may not enforce is ultra vires.

We await your taking the requested action, and as we do so, we will, of course, suspend further participation in these proceedings, including the hearing scheduled for January 26.

I was just made privy to a very important piece of research I had not previously been aware of. It comes by way of a comment forwarded to me by the author of the h2ooflife blog:

“I had presumed that the idiom “natural born citizen” appeared nowhere in U.S. Law other than A2S1C5, but I found it in administrative law and it is contrasted with native and naturalized citizenship. I’ve never seen any mention of this fact before and wonder how many are aware of it in the ineligibility camp. Here’s the quotes:

He then quoted two provisions from the link provided, but there’s actually three at the official INS “.gov” site which establish official recognition by the federal government that native-born and natural-born should be separately delineated. When you visit the suggested link to the Immigration and Naturalization service, it brings you to “Interpretation 324.2 Reacquisition of citizenship lost by marriage.”

Interpretation 324.2 (a)(3) provides:

“The repatriation provisions of these two most recent enactments also apply to a native- and natural-born citizen woman who expatriated herself by marriage to an alien…” (Emphasis added.)

Then, Interpretation 324.2(a)(7) provides:

“(7) Restoration of citizenship is prospective . Restoration to citizenship under any one of the three statutes is not regarded as having erased the period of alienage that immediately preceded it.

The words “shall be deemed to be a citizen of the United States to the same extent as though her marriage to said alien had taken place on or after September 22, 1922″, as they appeared in the 1936 and 1940 statutes, are prospective and restore the status of native-born or natural-born citizen (whichever existed prior to the loss) as of the date citizenship was reacquired.” (Emphasis added.)

And again, Interpretation 324.2(b) provides:

“The effect of naturalization under the above statutes was not to erase the previous period of alienage, but to restore the person to the status if naturalized, native, or natural-born citizen, as determined by her status prior to loss.” (Emphasis added.)

Three times in this official INS Interpretation – currently published by the Obama Administration – native-born and natural-born are given separate consideration. And in the third example – from Interpretation 324.2(b) – the INS clearly states that each delineation, “naturalized, native, or natural-born citizen“, is a separate status.

I called in and told the screener that I wanted to answer Roger’s question of why there were no records of Obama at Columbia. I was put on at 5:05 pm PST. (at the beginning of hour 3) (5:00 – 12:00 minutes of the broadcast)

Below I will summarize what I covered:

1. I participated in research that discovered Obama never attended Columbia, and heard the testimony of Wayne Allyn Root saying that he never attended school there with him.

2. I told Roger: You will have the answer to all your questions at a hearing in an Atlanta, GA courthouse, on Thursday, 26 January (‘I’ve heard about that’, said Roger, ‘but I don’t think it’s going anywhere’), where Judge Malihi has subpoenaed all those missing records. There will be 3 cases heard, telling us why there are no records (we don’t need Obama to be there), and determining whether a private individual (not ‘President’) named Obama should have his name on the GA Ballot as a candidate for the Office of President: ‘Article II says that ‘no person, except a natural born Citizen,… shall be eligible for the Office of President’.

3. (Roger then said we can be pretty sure that he was born in Hawaii, because they would not have put the announcement in the newspapers in anticipation of his running for president 48 years later).

‘Not so’, said I. The announcement that was published (if it was in fact actually published) in 2 newspapers were exactly the same, so they came from one ‘report’.

Also, you must be aware that someone born anywhere in the world could get an Hawaiian Certificate of Live Birth – simply by someone who lived in Hawaii reporting a birth (anywhere in the world). Imagine, if you will, a proud grandma being told by her daughter that she just gave birth to a son (e.g. in Kenya). That would not be a ‘future president’ conspiracy, it would simply be a proud grandma announcing the birth of her new grandson. The address of the announcement was the grandmother’s address.

This morning, I filed an AMICUS BRIEF in the Georgia POTUS eligibility cases. The brief complies with all Rules and procedures of the Administrative Court. The brief is 54 pages, and the appendix is 155 pages. The Rules of Court require attachment to the brief of all legal authorities, other than those issued by the federal government, or the State of Georgia. There’s some very esoteric law attached thereto.

I seriously urge everyone to familiarize themselves with Lord Coke’s Report from Calvin’s Case, as well as Chancellor Ellesmere’s argument, also in Calvin’s Case, for this is the true common law genesis of jus soli subjection, which happens to be a uniquely Christian tenet of law that has been completely misunderstood in this country for too long now. Calvin’s Case is universally recognized as the common law precedent relating to jus soli, but it is so much more fascinating than you can imagine. And it will forever revolutionize understanding of the words “natural-born”.

This book contains all of the relevant arguments and reports. But the original text of Lord Coke’s Report is the proper starting point. (This document is also in the appendix to my brief.) And here’s another source with slightly modernized English and extras.

This is a follow-up to something I posted yesterday. Before making my observations, I want to make a guarantee. If it turns out that I was wrong in my previous statement, I will gladly state that I was wrong, and issue a full apology to Orly about my legal assessment (which is something I already know would never be a reciprocal agreement). However, I am certainly not prepared to do that today, regardless of Orly's "I won!!! I won!!! I won!!!" foolishness. You see, unlike Orly, I am not going to look at a cow patty, and assume that because there is evidence of a cow somewhere, I get to serve ice cream to everybody right now. Let me rephrase that . . . SELL ice cream to everybody right now.

This is one of the issues I have already discussed—that everything from Orly seems to come with her own flavor of spin. And then, once the spin has been made, it is blindly believed by people (who just want so badly for it to be true), and it starts getting posted around the internet. Problem is, when it turns out that it wasn't entirely true, the only recourse Orly has is to scream "corruption!"

Let me make a couple points to try to put this into context. First, because the first response to "birthers" by many in this country is simply to blow us off as conspiracy theorists, Michael Jablonski submitted a sloppy, weak Motion to Quash. I'm sure he thought it would suffice with the judge—since the opposition were birthers; however, Judge Malihi obviously regards his role and the legal process much more seriously than that. And, because I'm sure he wants to make certain that, at the end of these HEARINGS (not trials), there is nothing that could be viewed as procedurally improper, he's not going to grant the professional attorney involved any special favors. He will hold somebody accountable to understand the law, and I'll leave it up to you to figure out whom that might be.

Here's what will probably happen: after Jablonski recovers from his blanket party, he will likely file an amended Motion to Quash; and it will probably be one of the most thorough Motions to Quash in the history of Motions to Quash, and Judge Malihi will probably grant that motion.

In the unlikelihood that Judge Malihi does not grant his amended Motion to Quash, there is something that is virtually guaranteed to happen: Obama not showing up to an administrative law hearing in the state of Georgia. Jablonski would appear on his behalf, and present a certified "birth certificate" and proof of residency for the past 14 years. As the certified "birth certificate" will be considered self-verifying by the court, nothing Orly will say will sway it. And remember, the end result of this hearing is a non-binding recommendation to the Secretary of State. So, no, Obama will not be handcuffed in Atlanta next week (he won't even be there).

I'm not trying to be a downer, or burst anybody's bubble—but, honestly folks—we need to stop spreading the spin all over the internet, just to be made fools of when what was posted never happens. I'm amazed at the number of people who haven't figured that one out with Orly yet. It's just not going to happen like we want it to.

Actually, this denial of the Motion to Quash still doesn't address the invalidity of all the other out-of-state subpoenas Orly mailed (not served). Since Jablonski lives and works in Georgia, he was technically served. Nobody who lives outside of Georgia has been served.

As we have all come to expect, Orly continues to show the most debased levels of egomania, and still tries to attack others who have worked on this team as long as she has. She still has all the graciousness of a cactus loofah, and the attitude of a spoiled brat child (who is the only one who deserves your donations, and if you don't donate, you're an Obama operative).

So, again, when we're on the other side of this HEARING, and it turns out I am wrong, I'll freely admit it. However, and unfortunately for our side, I'm not wrong—so get ready to hear endless wails of "corruption." And, I do want to make a side note here before signing off: Orly's incompetence is, by no means, to be construed as an indictment against the other two hearings that will take place. Both of those cases have real attorneys involved, so I am hopeful that they will be able to produce positive results. It's funny . . . I haven't heard those other lawyers publicly proclaim ME, ME, ME even once. That alone gives me some hope about their cases.

ORDER ON MOTION TO QUASH SUBPOENAS

Defendant, President Barack Obama, a candidate seeking the Democratic nomination for the office of the President of the United States, has filed a motion to quash the subpoena compelling his attendance at the hearing on January 26, 2012.

In support of his motion, Defendant argues that "if enforced, [the subpoena] requires him to interrupt duties as President of the United States" to attend a hearing in Atlanta, Georgia. However, Defendant fails to provide any legal authority to support his motion to quash the subpoena to attend. Defendant's motion suggests that no President should be compelled to attend a Court hearing. This may be correct. But Defendant has failed to enlighten the Court with any legal authority. Specifically, Defendant has failed to cite to any legal authority evidencing why his attendance is "unreasonable or oppressive, or that the testimony... [is] irrelevant, immaterial, or cumulative and unnecessary to a party's preparation or presentation at the hearing, or that basic fairness dictates that the subpoena should not be enforced." Ga. Comp. R. & Regs. r. 616-1-2-.19(5).

Defendant further alludes to a defect in service of the subpoena. However, the Court's rules provide for service of a subpoena upon a party, by serving the party's counsel of record. Ga. Comp. R. & Regs. r. 616-1-2-.19(4). Thus, the argument regarding service is without merit.

Accordingly, Defendant's motion to quash is denied.

SO ORDERED, this the 20th day of January, 2012.

Breaking News: January 19, 2012 ~ Precedent Case For Restraint of Fund Raising for Obama: Writ of Mandate ~ Served on the California Secretary of State.

Sacramento – A legal complaint was served on Obama for America (California) and the California Secretary of State Debra Bowen late Tuesday to keep British-born Barack Obama off the ballot for the Office of the President, because he does not meet the Constitutional requirement of being a U.S. Natural Born citizen according to the Supreme Court precedent Minor v. Happersett. The legal action was filed Jan. 6 in Sacramento Superior Court by a group of 7 ad hoc registered voters including an American Independent Party candidate for President.

Several of the petitioners tried seeking resolution against Obama after the 2008 presidential election, but they were told by the California courts that it was too late to make challenges to Obama’s legitimacy, and that they did not have “standing”.

The Writ requests a temporary restraining order of Respondent Debra Bowen (SOS) to bar Obama on the Democratic Party ballot in the primary and/or General Election until the matter of eligibility and ballot access for Respondent Obama is heard. The Writ also requested a temporary restraining order against Respondent Obama and or his agents associated with the Obama for America California from further fundraising in California until further notice by the court. A final demand was for a permanent Injunction against Respondent Obama and Respondent SOS as to Respondent Obama’s ineligibility, barring him from ballot access.

Seven California voters have drawn up the Writ of Mandate over the absence of Constitutional authority and documentation that Barack Obama is eligible to occupy the Oval Office. No dual nationality citizen has ever been declared a U.S. NATURAL BORN Citizen. The Supreme Court ruled in Minor v. Happersett that a person must be born within the jurisdiction of the U.S. to two U.S. citizen parents and it has been never been overturned. The U.S. Congress in 2009 usurped the U.S. Constitution when they confirmed Mr. Obama for the Office of the Presidency. They attempted to revise the U.S. Constitution without an Amendment by confirming Obama as POTUS.

One of the seven California Petitioners is Edward C. Noonan of Olivehurst, Yuba County, CA. He is currently a 2012 Presidential candidate for the American Independent Party.

The other six California petitioners are Pamela Barnett (Director of ObamaBallotChallenge.com), Sharon Chickering, George Miller, Tony Dolz, Neil Turner, and Gary Wilmott. All seven petitioners are affirmed as Ad Hoc registered voters of California, each self represented without an attorney.

The cause of the petition is that Mr. Barack Obama does not qualify for the Office of President of the United States because both of his parents were not U.S. Citizens at the time of Obama’s birth. Article II of the US Constitution states that only Natural Born Citizens qualify for the Office of President. Barack Obama’s father was a foreign national of Kenya. This disqualifies Mr. Obama to be Commander in Chief as well as POTUS.

*UPDATES* Obama's Georgia attorney filed a motion to quash the Georgia subpoenas in the Farrar, et. al. v Obama ballot access challenge. Although we disagree 100 percent with Michael Jablonski(Obama atty) on his political arguments, the legal argument with respect to the administrative subpoenas having only limited powers and only within the State of Georgia is correct. Read the full motion provided below. Much of it is garbage however the part about the out-of-state rules is spot on. Also the response to one of the subpoenas provided below from the Department of Health and Human Services.

Obama's motion to quash:

"The sovereignty of the State of Georgia does not extend beyond the limits of the State. O.C.G.A. § 50-2-20. Since the sovereignty of the State does not extend beyond its territorial limits, an administrative subpoena has no effect. Thus, OSAH rules specify that subpoenas must be served within the State of Georgia. Ga. Comp. R. & Regs. r. 616-1-2-.19(5) (“A subpoena may be served at any place within Georgia….”)."

"Plaintiff‟s attorney violates two rules of practice with these subpoenas. First, they must be served within the State of Georgia. Ga. Comp. R. & Regs. r. 616-1-2-.19(5) (“A subpoena may be served at any place within Georgia….”). The sovereignty of the State of Georgia does not extend beyond the limits of the State. OCGA 50-2-20. The attempted use of these subpoenas to obtain documents from Hawaii and State of Washington is improper. Subpoenas issued by Georgia courts do not have extraterritorial power. Hughes v. State, 228 Ga. 593, 187 S.E.2d 135 (1972)

Here's an excerpted response from Dr. Taitz, Esq.'s blog:

1. most of his motion is a total BS, irrelevant material, improper attacks on plaintiff’s counsel with an attempt to prejudice the court

2. Obama has no standing to challenge subpoenas issued and addressed to other parties. If other parties want to challenge, it is up to them. It is interesting that he mentions Susan Daniels, John Smpson and Loretta Fuddy, I wonder why? Is there something in their testimony he does not want to be heard by the judge?

3. there is nothing in subpoena issued to him, that is improper or oppressive

4. he was properly served through his attorney in Atlanta GA, within the jurisdiction

We want nothing more than to have witnesses put on the record detailing Obama's many discrepancies but the proper court procedures and rules must be followed to attain that. Obama should have to be there though. That is HIS hearing.

BIRMINGHAM, Alabama --- The Jefferson County judge who dismissed a Luverne man's lawsuit to block President Obama from Alabama ballots today also ordered him to pay the state Democratic Party's court costs and lawyer fees within 45 days.

Lawyers for Mark Kennedy, the state party chairman, sought the sanctions in a motion his lawyers filed last week filed last week in the suit filed by Harold Sorensen. But one of the lawyers said during a hearing today that party officials would not try to collect if Sorensen does not file any similar lawsuits during the 2012 election cycle.

"The Democratic Party has no desire to chase after a retired military man to collect," Barry Ragsdale, one of Kennedy's lawyers, told Circuit Judge Helen Shores Lee.

Ragsdale then turned to address Sorensen. "But if I read you're bad-mouthing the court and this decision, you will feel the full wrath of me."

Sorensen told Lee he cannot afford to pay the court-ordered costs.

Ragsdale said Sorensen's suit in Jefferson County is the second one he has filed challenging Obama's citizenship and right to serve as president. A Montgomery County judge in 2009 dismissed the other Sorenson suit, which also challenged then-Republican nominee John McCain's citizenship.

"This needs to stop, Mr. Sorensen, and it needs to stop today," Ragsdale said during the hearing.

Ragsdale also criticized a request Sorensen filed last week asking Lee to step aside from his case. The motion, which Sorensen filed without counsel, cited "racial bias, lack of judicial discretion as well as lack of knowledge of the U.S. Constitution, Article II, Section 1, Clause 5," court records show.

"This is scandalous," Ragsdale said to Sorensen during today's hearing. "It's uncalled for and you owe this court an apology."

Sorensen apologized. He told Lee he did not seek a new judge because of the black judge's race.

Amid ongoing challenges to Barack Obama’s presidential eligibility, some have raised questions about the constitutional status of the leading candidate for the Republican nomination, Gov. Mitt Romney, contending he was born in Mexico or that his father was not an American citizen at the time of his birth.

However, the available evidence shows that even under the strictest interpretation of Article 2, Section 1 of the Constitution, Romney is a natural-born citizen, according to Article 2, Section 1.

The questions have been raised because Romney’s grandparents went to Mexico in the 1800s, where Mitt Romney’s father, George W. Romney, was born, July 8, 1907.

A genealogy of Mitt Romney has been prepared by eligibility researcher Charles Kerchner.

According to a Romney family genealogy prepared by the London, England, LDS Temple, Romney’s grandparents – Gaskell Romney and Anna Amelia Pratt Romney – were polygamous Mormons who fled the United States when the Mormon church disavowed polygamy. As the genealogy points out, polygamy was a federal crime in the U.S., but it was allowed in Mexico.

The grandparents were even married in Mexico, although each of them was born to a U.S. citizen father in U.S. sovereign territory.

Gaskell Romney was born Sept. 22, 1871, in St. George, Washington County, in the Utah Territory;

Anna Amelia Pratt Romney was born May 6, 1876, in Salt Lake City, in the Utah Territory.

After the Mexican Revolution broke out in 1910, the Mormon colonies began to be endangered, starting in 1911-1912 by raids from marauders. In response, Romney’s grandparents fled Mexico, taking their 5-year-old son, George W. Romney, with them. They settled first in Oakley, Idaho, and finally in Salt Lake City, Utah.

When George W. Romney ran for president in 1968, Charles Gordon, a counsel with the U.S. Immigration and Naturalization Service and an Adjunct Professor of Law at the Georgetown Law Center, addressed the eligibility issue in an article in the Winter 1968 issue of the Maryland Law Review.

Charles Kerchner(ret) commented at WND: "Mitt Romney's father George Romney born in Mexico was a Citizen of the U.S. at birth via his citizen parents by the "jus sanguinis" laws of the U.S. going back to the founding of our nation, thus he did not have to file naturalization papers. Rick has yet to produce copies of those papers. Cdr. Kerchner(ret) also commented at the Post & Email's report on the Mitt Romney Ballot Challenge saying in part: "People who are challenging Mitt Romney would have to prove that both his grandfather Gaskell and his grandmother Anna renounced and/or totally lost their birthright U.S. Citizenship when they lived as expatriates in Mexico. The U.S. Nationality Act of 1940 says they did not. That law was enacted 7 years before Mitt was born in Detroit MI in 1947.

The Objectors

January 13, 2012: Today, a group of Illinois citizens are filing objections to the petitions to place Barack Obama on the presidential primary ballot in Illinois. If successful, Obama will not appear on the ballot in the March 20 primary election.

The group issued the following statement:

“This is a protest against Chicago machine corruption in Illinois. We are attempting to remove Obama from the ballot using the same tactics he used in his first election. Obama removed his primary opponent for Illinois Senate with a petition challenge, and denied the voters a choice to vote for anyone but him.

“The Chicago Democratic Party has rigged the system using arcane election laws so that it is difficult, and often impossible, for anyone other than an incumbent to win an election.

“They have created a petition process that ordinary citizens cannot navigate. If your petitions aren’t numbered or bound correctly, or lack the exactly correct language, you are denied ballot access.

“They have gerrymandered the districts across Illinois specifically for incumbent protection through the use of racial politics. They divide the people based on race, and if you’re the wrong color, you have an uphill climb.

“They have created a system where local Alderman grant and deny access to city services based on political affiliation. Business owners won’t put up campaign posters for fear of having liquor licenses or zoning permits denied. Residents are fearful that their garbage won’t be picked up or their sidewalk fixed if they’ve got the wrong sign in their yard. If you’re not part of the Machine, you are routinely denied access to public speaking forums in the communities groups that depend on the good graces of the local Alderman.

“These tactics may be alien to many outside of Chicago, but it’s an unfortunate way of life here. This is the system that spawned Barack Obama and Rahm Emanuel. These are the tactics that they use here, and use on a larger scale in Washington.

“We think it’s time that the rest of the country know about it, and for Barack Obama to be hoist with his own petard.”

The Obama campaign filed approximately 4,500 signatures to put Obama on the primary ballot. The required number was 3,000. Many of the signatories were not registered to vote, signed more than once, or neglected to add their address.

Multiple petition sheets lacked the circulator’s signature or were not notarized.

The signatures were filed on the last day of the filing period, and were “done in a sloppy way” according to multiple local election lawyers. It is common to file a greater number of signatures than the Obama campaign filed to account for signers who are not registered to vote.

Petition challenges were recently used to deny Newt Gingrich and Rick Perry ballot access in Virginia.

Informally dubbed the “Chicago Objectors”, the group is comprised of concerned voters who are tired of Chicago machine corruption in Illinois.

It’s unclear whether a successful challenge to Obama’s entry onto primary ballot will prevent him from appearing on the ballot in the presidential election in the fall.

Cleveland’s group, the Chicago Objectors, filed the challenge with the Illinois State Board of Elections late this afternoon, just before the filing deadline.

The group claims the Obama campaign filed roughly 4,500 petitions, many of which were for unregistered voters, were duplicates, had incorrect addresses, or didn’t have a signature, and as a result, the Obama campaign may not have submitted the required 3,000 valid signatures. Cleveland blames the so-called “Chicago Machine” for putting into place rules that make it difficult for anyone to challenge the incumbent. “You know, Barack Obama has fallen short of those rules.”

Members of the Chicago Objectors consist of Republicans, Democrats and election lawyers, according to Cleveland. He says the group, in one week’s time, did a massive check of the motor voter registration rolls. “We have had a handful of members in the office, a very small team, checking signatures, and then we had an outside data-processing firm run the election data for us.”

First off, Birther Report doesn't make money selling news or selling anything else. There’s not even any paid advertising running on BirtherReport.com. The only one time BR sought monetary contributions was I believe around two years ago for a third highway billboard publicizing Obama's Article II ineligibility and identity document fraud. As you may or may not know highway billboards in a good location do not come cheap. Only a couple people contributed very small amounts so the third one hasn’t been possible. As you do know there are costs to retain domains and many other costs associated with computers, software, programs, which all costs money. BirtherReport.com does not push for or spam for contributions on a daily, weekly, monthly, or yearly basis for any one the listed personal costs. BirtherReport.com-ObamaReleaseYourRecords.com is really not even owned by the person you think. Not to mention various other people help out with the BR/ORYR facebook groups. And then there is the Youtube and Scribd page, which, by the way, do not run paid advertising either. It has never been about money.

Upon consideration of petitioner Dr. Orly Taitz’s petition for a writ of mandamus, it appears that petitioner fails to demonstrate an entitlement to mandamus relief. See Kema v. Gaddis, 91 Hawai5i 200, 204, 982 P.2d 334, 338 (1999) (A writ of mandamus is an extraordinary remedy that will not issue unless the petitioner demonstrates a clear and indisputable right to relief and a lack of alternative means to redress adequately the alleged wrong or obtain the requested action. The friend then told us:

Last time I spoke to Stefan was about a week ago and we were working on getting him up to Jacksonville for a new treatment at University of FL. At some point after that call he aspirated and had to be admitted to the hospital and put on a ventilator which he was taken off yesterday. I had been leaving messages for Stefan and his daughter finally reached me this AM with the news. She is not very confident that Stefan is going to survive this.

SAN JUAN, Puerto Rico -- Fifty people have been accused of conspiring to sell the identities of hundreds of Puerto Ricans to illegal immigrants on the U.S. mainland in the largest single fraud case ever for U.S. Immigration and Customs Enforcement, authorities said Wednesday.

Hundreds of birth certificates, Social Security numbers and driver's licenses were sold for up to $2,500 a set as part of a black market ring based in Puerto Rico that operated from since at least April 2009, according to ICE Director John Morton.

"The vast majority were legitimate documents obtained by fraudulent or false means," he said.

The alleged ring consisted of suppliers, runners and brokers, who made coded phone calls asking for "skirts" for female customers and "pants" for male customers in specific "sizes", which referred to ages and identities sought, according to ICE.

The documents would be sent through priority or express mail from Puerto Rico to brokers that operated in at least 15 states including Ohio, Texas, Florida and North Carolina, officials said.

Assistant Attorney General Lanny Breuer said suppliers even allegedly offered to exchange documents if customers were not satisfied, adding that he did not know how much money was made overall.

He said the investigation is still ongoing.

Editor's note: For months now, comments and private messages submitted to this site related to posts reporting on Dr. Orly Taitz’s legal work has run the gamut from faithful support to questioning her strategy to outright accusing her of legal malpractice. Today, we received a letter from a concerned citizen who resides in Georgia questioning recent legal maneuvers Dr. Taitz has made that may or may not have bearing on the January 26, 2012 OSAH hearing.

In an effort to provide clarity to our readers in regards to this critical issue we are reprinting this letter in full - UPDATE BELOW

Dear Birther Report Editor,

I have considered myself a “birther” for quite some time now, and I do occasionally contribute financially to the cause. At the very least, I try to keep up with all of the news regarding the usurper in our White House, and there is something that has been bothering me lately, to the point that I feel the need to voice my concern.

Not only do I try to keep up with all of the different efforts, I also follow all the lawsuits filed by Dr. Orly Taitz, and other than the fact that it often looks like she is more concerned with promoting Orly Taitz than she is with the very important task at hand for the American people, I tend to look past that, because she does bring a lot of attention to the fraud that has been committed, and I commend her for that.

However, there is something I can no longer look past, because it is something that speaks to character, and in this huge battle, I believe keeping ourselves above board and honest to be of the utmost importance.

Recently, Dr. Taitz has been stating on her website and elsewhere that Georgia Judge Michael Malihi has issued subpoenas related to her Georgia case, and she has even posted images of the subpoenas. Does she really think that people are that gullible? She has done nothing but download pre-signed subpoena forms from the Georgia OSAH website (www.osah.ga.gov) that are made available to attorneys involved in cases there. Even nobodies like I know that a Georgia Administrative Court doesn't have the power to subpoena officials from other states! So, how dishonest is it for Orly to represent that Judge Malihi doesn't understand that simple legal principle, and that he is issuing these subpoenas? Even if he did have that power, it would be a lie that his court issued the “subpoenas” that Orly is posting and gloating about. Downloading blank forms and filling them out is not the same as a judge-issued subpoena!

It appears the Georgia Office of State Administrative Hearings is on to Orly's dishonesty now, because the link (http://www.osah.ga.gov/documents/subpoenas/subpoena.doc) they have for those blank subpoena forms is now dead!

Here is my why I am writing to you. It has been difficult enough for us to be heard on the facts that we know are true—and when one of the “names” in the movement is so publicly dishonest, it just discredits everything that the movement has worked so hard to accomplish. It also causes me to wonder what else Dr. Taitz has not been honest about! Is she just spreading lies hoping that it will cause people to donate more money to her? Just a little bit of research showed me that Mr. and Mrs. Orly live in a $3 million home in Laguna Niguel, CA. It looks like they already have a lot more money than most of us do, but she's the most vocal in the entire movement with the money-begging.

Does she occasionally smear the good names and efforts of others in the movement as a way to divert possible donations away from them and to her, or is it just that, in her mind, she must be the only one in the spotlight? I can't imagine that most donations amount to all that much—they certainly cannot be worth enough for someone to forfeit their honor and integrity. But that's what I tend to see from Dr. Taitz.

I know this has been a long note, and that wasn't my intention, but here is the real question I want to ask you. Why aren't all the good people who are so active in this movement publicly denouncing these tactics? I'm sure they all know that Orly has never gotten a subpoena issued from Judge Malihi. If they all know these are lies, why aren't they publicly condemning the deception?

Attorney Taitz posted a response to the above letter here. The main concern was not addressed in regards to the issuance of said subpoenas per court rules and procedures outlined by the Office of State Administrative Hearings of the State of Georgia.

Al Hendershot: "The opposing attorney told the Judge that she did not have jurisdiction to hear the case. Judge Lee stated in a meeting in her chambers that the Motion for Recusal was denied. Judge Lee's comment regarding my reasoning of judicial bias stated: "Is the bias due to me (Judge Lee) and our President Obama are both black?" The Judge denied my constitutional right to legal council as well as a Court Reporter. Therefore, I requested to withdraw my case which was summarily denied. The Judge, after denying my request to withdraw the case then stated "Case dismissed."

This Morning unbenounced to the court, there were two other cases filed at exactly 8:30AM (before my case was even heard at 9:15AM) in two other separate cases asking for the same temporary injunction. So technically these two other cases will have to be heard on their merits. So we now have two more temporary injunctions which will still prevent the anointed one from being added to the 2012 Primary Ballot in Alabama by 01/19/2012. They will be served again..."

Part 1: JUSTICE GRAY MISQUOTED McCREERY V. SOMERVILLE AND THE RELEVANT STATUTE.

Grab a cup of java, put your thinking caps on, kick back and relax. We are going to be here for a while. Focus. Below, you will be privy to a true and proper revision of United States Supreme Court history.

One of the foundational building blocks for Justice Gray’s opinion in U.S. v. Wong Kim Ark is the case, McCreery v. Somerville, 22 US 354 (1824), to which Gray made a fatally flawed assumption based upon his failure to acknowledge a judicially recognized misquote. Then, Justice Gray compounded his initial error by creating a separately deceptive quotation.

These errors completely sully his analysis of McCreery. Gray failed to inform his opinion in Wong Kim Ark with the fact that the U.S Supreme Court had questioned that opinion in 1881, just prior to Gray having joined the Court.

In Sullivan v.Burnett, 105 U.S. 334 (1881), the Court stated:

“This view is controverted by the plaintiffs on the authority of McCreery’s Lessee v. Somerville, 9 Wheat. 354, where this Court had occasion to determine the meaning of the statute of 11 & 12 William III. c. 6,…We remark in reference to that case that the English statute is not accurately quoted in the opinion of the Court, as an examination of 10 British Stat. at Large 319 (Pickering’s Ed.) will show. but without deciding that the words omitted ought to have produced a judgment different from that rendered, we are of opinion that the present case is not governed by McCreery’s Lessee v. Somerville.” Sullivan v. Burnett, 105 U.S. 334, 340-341. (Emphasis added.)

The misquote would not have changed the outcome in McCreery since the issue of the plaintiff’s citizenship status made no difference to the case, where the plaintiff could not inherit from a living ancestor. In Sullivan v. Burnett, the Missouri statute did allow for inheritance through a living ancestor, so McCreery was not controlling. However, the misquote completely nullifies Justice Gray’s assumption in Wong Kim Ark. And considering that McCreery is the only Supreme Court holding prior to Wong Kim Ark which appeared to assume that native-born persons of alien parents were citizens, the embarrassment of the failed assumption further weakens the questionable reputation of Justice Gray’s controversial opinion.

I came upon the Sullivan case by way of a footnote found at the Princeton Firestone Library, which has the dusty old Wheaton Supreme Court Reporters. Wheaton added a footnote to McCreery v. Somerville regarding the misquote.

I have learned from experience that every point of authority mentioned by Justice Gray in his 55 page opinion must be examined under a microscope, and that the resulting picture is more often than not quite different than he alleges. These anomalies include straight forward mistakes, unfounded assumptions, misquotes and subtle acts of misdirection. Nothing can be taken at face value. Considering that Gray was indirectly determining the citizenship status of President Chester Arthur (who appointed him), the appearance of impartiality has been severely compromised. In the days ahead, I will present all of the problems now associated with Gray’s opinion in great detail. Today, we begin with McCreery v. Somerville.

Justice Gray assumed that the Supreme Court in McCreery made it’s own assumption that the plaintiff in McReery was a “native-born citizen” of the United States:

“In McCreery v. Somerville (1824) 9 Wheat. 354, which concerned the title to land in the state of Maryland, it was assumed that children born in that state of an alien who was still living, and who had not been naturalized, were ‘native-born citizens of the United States’; and without such assumption the case would not have presented the question decided by the court, which, as stated by Mr. Justice Story in delivering the opinion, was ‘whether the statute applies to the case of a living alien ancestor, so as to create a title by heirship, where none would exist by the common law, if the ancestor were a natural-born subject.’ Id. 356.” U.S. v. Wong Kim Ark, 169 U.S. 649, 661.

Before we get to the misquote by Justice Story in McCreery (which was reiterated by Gray), we have in the quote above a very misleading quotation that appears intentional. Justice Gray cites to pg. 356 of McCreery at the end of the passage wherein he placed quotes around ‘native-born citizens of the United States’. But no such quote appears on pg. 356. In fact, the Court’s opinion in McCreery nowhere states that the plaintiff was a U.S. citizen, native-born or otherwise. The headnote and facts agreed upon by the parties call the plaintiff a citizen, but these are not part of the Court’s opinion, and are not law.

Since the plaintiff’s ancestor was alive, the Court held that the plaintiff could not inherit from him. And this would have been the holding regardless of the plaintiff’s citizenship status. Having determined that the plaintiff couldn’t inherit from that particular ancestor, the Court never reached the direct issue of her citizenship. And a thorough review of the facts and the British statute construed in McCreery reveals that the Court would not have been required to determine she was a native-born citizen of the U.S. in order for her to inherit.

Greetings,

I write as an “interested person” requesting that you institute Quo Warranto proceeding against Barack Obama pursuant to D.C. Code, Division II, Title 16, Chapter 35, §3502 on your own motion, or if you prefer, upon relation to me.

As an initial matter, I maintain that I am a “person interested” as referenced in §3503 as I am a declared write-in candidate for the November 6, 2012, election for the office of President of the United States. See: Exhibit “A”. As such, under the plain language of Newman v. United States ex Rel. Frizzell, 238 U.S. 537 (1915), I have standing to make this request of you.

Clearly, under §3501, Barack Obama, “within the District of Columbia . . .holds or exercises, a franchise conferred by the United States or a public office of the United States”, to wit, (i) in the District of Columbia, a place upon the November 6, 2012, ballot as the Democratic candidate for President of the United States and (ii) the office of President of the United States. As more fully described below, I maintain that, in both cases, he “usurps, intrudes into, or unlawfully” holds or exercises such franchise and/or public office in violation of §3501.

Indisputably, in order to be President of the United States, Article II, §1, of the U.S. Constitution requires: “No person except a natural born Citizen . . ., shall be eligible to the Office of President.” The phrase “natural born Citizen” is a 18th Century legal term of art with a definite meaning. At the time of the adoption of the Constitution, that phrase was defined as: “The natives, or natural-born citizens, are those born in the country, of parents who are citizens.” (The Law of Nations, Emerich de Vattel, 1758, Chapter 19, § 212).

On July 25, 1787, John Jay wrote to George Washington, the presiding officer of the Constitutional Convention, stating: “Permit me to hint, whether it would be wise and seasonable to provide a strong check to the admission of Foreigners into the administration of our national Government; and to declare expressly that the Commander in Chief of the American army shall not be given to nor devolve on, any but a natural born Citizen.” (Farrand's Records, Volume 3, LXVIII. John Jay to George Washington). Subsequently, On August 22, 1787, it was proposed at the Constitutional Convention that the presidential qualifications were to be a “citizen of the United States.” (Farrand's Records – Journal, Wednesday August 22nd 1787). It was referred back to a Committee, and the qualification clause was changed to read “natural born citizen,” and was so reported out of Committee on September 4, 1787, and thereafter adopted in the Constitution. (Farrand's Records, Journal, Tuesday September 4, 1787).

Though there is no record of debates upon the subject, the Federalist Papers contain a contemporary comment on it written by Alexander Hamilton which reads: “Nothing was more to be desired, than that every practicable obstacle should be opposed to cabal, intrigue, and corruption. These most deadly adversaries of Republican government, might naturally have been expected to make their approaches from more than one quarter, but chiefly from the desire in foreign powers to gain an improper ascendant in our councils. How could they better gratify this, than by raising a creature of their own to the chief magistracy of the Union?” (The Federalist Papers, LXVIII.)

Supporting this view, is Mr. Justice Story who wrote: “It is indispensable, too, that the president should be a natural born citizen of the United States . . . The general propriety of the exclusion of foreigners, in common cases, will scarcely be doubted by any sound statesman. It cuts off all chances for ambitious foreigners, who might otherwise be intriguing for the office; and interposes a barrier against those corrupt interferences of foreign governments in executive elections, which have inflicted the most serious evils upon the elective monarchies of Europe. (Story on the Constitution, Vol. 2, page 353-54.)

Clearly, Barack Obama has represented that he is the son of a non-citizen of the United States, Barack Hussein Obama, Sr., who was a citizen of Kenya. A man who was on the American Independent Party’s presidential ticket in California in 2008 as well as a certified elector for the party have asked a full panel of a federal appeals court to hear their claim that Barack Obama wasn’t qualified to be president, stacking the election unfairly against qualified candidates.

In the case, that a three-judge panel of the 9th U.S. Circuit Court of Appeals recently determined that election fraud suspected in the campaign essentially became moot when Obama was inaugurated.

The lawsuit was filed on the day of Obama’s inauguration. Obama flubbed the oath of office, and the White House reported he retook it in private later.

The case represents the work of two groups of plaintiffs, one led by lawyer Orly Taitz and the other by attorney Gary Kreep of the United States Justice Foundation.

The petition for a rehearing of the full bench was filed today by Kreep on behalf of his clients. Taitz earlier told WND her plaintiffs will pursue further action but which step would be taken was as yet unclear.

Kreep’s clients are Wiley S. Drake, a candidate for the White House on the American Independent Party ticket in California; and Markham Robinson, a certified California elector for the American Independent Party.

The judges had observed: “These plaintiffs argue that they have standing because, as candidates running against Obama in the 2008 election, they had an interest in having a fair competition. … If Obama entered the presidential race without meeting the requirements for the office, they contend, the candidates did not have a fair opportunity to obtain votes in their favor.”

The opinion from the panel of judges Harry Pregerson, Ray Fisher and Marsha Berzon explained the concept is called “competitive standing,” and they affirmed it as legitimate grounds for concern.

“This notion of ‘competitive standing’ has been recognized by several circuits,” the opinion said. “We, too, have upheld the notion of ‘competitive standing.’ In Owen v. Mulligan, we held that the ‘potential loss of an election’ was an injury-in-fact sufficient to give a local candidate and Republican party officials standing. In that case, the candidate for local office sued the Postal Service for giving his rival a preferential mailing rate, in violation of its own regulations.”

The opinion said the case had the candidate and party officials seeking “to prevent their opponent from gaining an unfair advantage.” However, in Obama’s case, the court panel simply said that once the inauguration was held, the claims evaporated, because the plaintiffs no longer were “candidates.”

“The original complaint was filed Jan. 20, 2009, at 3:26 p.m. Pacific Standard Time, after President Obama was officially sworn is as president,” the judges wrote. “Once the 2008 election was over and the president sworn in, Keyes, Drake and Lightfoot were no longer ‘candidates’ for the 2008 general election. Moreover, they have not alleged any interest in running against President Obama in the future.

The opinion neglected to note Obama’s flub of the oath of office and his decision to retake it later.

However, the petition to the appeals court noted that Berzon, in a hearing in May, “mentioned that the issue raised in this case was an important constitutional issue that needed to be resolved.”

But the opinion itself said nothing on the issue.

Alabama Judge Denied Albert Hendershot's Motion for Stay in Obama Ballot Access Lawsuit Against Alabama Democratic Party

Judge Helen Shores Lee has issued an order related to the Alabama lawsuit filed by Albert Hendershot against the Alabama Democratic Party seeking an injunction for Obama's name being placed on the primary ballot. Yesterday Hendershot filed a Motion to Stay so he could have legal representation at the hearing scheduled for January 9th, 2012.

The court order reads:

"The Motion to Stay, filed on January 5, 2012, by Plaintiff, Albert E. Hendershot Jr., came before this Court on January 6, 2012.

After giving due consideration thereof, said motion is hereby DENIED.

Accordingly, the hearing scheduled for the above mentioned case will proceed as scheduled on January 9, 2012, at 9:00 a.m., in Courtroom 650, Jefferson County Courthouse, Birmingham, Alabama. Please mark your calendars accordingly.

Update on New Lawsuit Filed Against Hawaii Department of Health on Behalf of Virginia Sunahara's Brother, Duncan Sunahara

As first reported here, brother of Virginia Sunahara, Duncan Sunahara, has filed suit against Hawaii to obtain access to Virginia's original long-form birth certificate. Dean Haskins of the Birther Summit lays out the details below. See the complaint here.

WAS BABY VIRGINIA SUNAHARA'S IDENTITY STOLEN?

As was previously reported, in October and November, we spent a total of 2 ½ weeks in Hawaii on an investigative assignment. It was at the beginning of that stay that we met Duncan Sunahara, a highly informed, but unassuming guy, complete with his signature coconut palm frond hat. He was a military veteran with an obvious deep love for his country.

Early last year, Duncan had become aware of some possible issues surrounding his late sister Virginia's birth certificate, and had spent quite a bit of time on his own trying to get his questions answered. As he related to us, it seemed he was getting nothing but a "run around" from the Department of Health, and the area hospitals. Oddly, it had been reported in 2010 that DOH Director, Loretta Fuddy, had claimed that no records existed for Virginia Sunahara.

Duncan knew that his sister was born in the same hospital that he had been a few years earlier, and that she was transferred to another hospital, but he didn't know which one (and his elderly mother could not remember). He had visited the birth hospital, Wahiawa General, and both Queen's and Kapi'olani Medical Centers, but was not able to obtain any information from them. We were able to help him procure all of the medical records from the day Virginia spent in Wahiawa General, and found that she was transferred to Kapi'olani, but Kapi'olani insists they have no records on file. It does seem odd that Wahiawa would have the records, but Kapi'olani supposedly does not (how much room could it take to store a roll of microfilm?). This certainly seems "convenient" for them.

When we visited the Department of Health, we weren't quite sure what we would find, since Loretta Fuddy had insisted that Virginia's records didn't exist. However, we were pleasantly surprised that Duncan's application produced several certified copies of Hawaii's new short form birth certificate (which they now absurdly call their "long form"). Upon closer inspection, we learned that the number assigned to Virginia's birth certificate is 151-1961-011080, and realized that, statistically, that number simply cannot be legitimate.

Now, here's what's wrong with that number: we all know that the last group of numbers on the "certificate" Barack Obama claims is his official record is 10641, and his certificate was supposedly processed on August 8, 1961. We also know that the Nordyke twins were assigned the numbers 10637 and 10638, and their certificates were processed on August 11, 1961. Virginia Sunahara's birth certificate states that it was processed on August 10, 1961, but the number it was assigned is 443 higher than the Nordyke twin whose certificate was stamped with the number 10637.

We know that there were 17,616 births in Hawaii in 1961, which shows a statistical average of 48 births per day. To arrive at the number now assigned to Virginia's birth certificate, nine to ten days would have had to have lapsed after the Nordyke twins' certificates were processed, but Virginia's processing date was the day BEFORE the Nordyke's.

To refute the ridiculous argument that birth certificate worksheets were pre-numbered, and clerks kept small stacks of them on their desks for processing, that is not only patently false, but also, by federal law, would be illegal. Birth certificate "worksheets" (what they call blank birth certificate forms) are kept at the hospitals, and it is there where the information is entered onto them. Once all the information has been entered, they are sent to the DOH, where they are processed using a Bates machine, which enters certificate numbers sequentially, and then the date of processing is stamped onto them. Basement bloggers who suggest otherwise simply prove their lack of factual knowledge with that argument (as if any further proof of that were needed).

We went back to the DOH the next day to try to obtain a photocopy of Virginia's original birth certificate, but were told that Duncan was not allowed to receive that (according to DOH rules). When we pointed out to Supervisor Jesse Koike that their "rules" were illegal, according to Hawaiian statutes, he told us that Duncan would have to discuss that with Dr. Alvin Onaka. We spent four hours waiting to speak with Onaka, who eventually instructed the security guard to throw us out of the facility (which seems to be outrageous behavior from someone with nothing to hide). Duncan also made several phone calls trying to make an appointment to see Onaka, but could not get him even to return his calls.

We then sent a certified letter to Onaka requesting the photocopy, and also included the relevant statutory information, and were informed in writing that we would have to take the matter up with Hawaii's Attorney General, which we did. The response we received from the AG contained the same deceptive misinterpretation of the statute, so, as a final step toward filing a complaint with the court, Duncan sent a letter asking for an estimate of how much it would cost for the DOH to perform the necessary research to copy, and send, Virginia's original birth certificate. No response was ever received from the DOH.

Having attempted every administrative procedure to obtain that to which Duncan is statutorily entitled, a lawsuit was filed on Tuesday, January 3, 2012.

It is still unbelievable that, in 2008, our so-called media dispatched teams to sift through Sarah Palin's trash looking for anything they could find to discredit her, but did nothing of the sort regarding an empty suit Marxist from Chicago who refused to provide any substantive documentation regarding his eligibility. When the media and the politicians refuse to do their jobs, it is up to "We the People" to do it for them—and that is exactly what we are continuing to do. Court to Hear Obama Eligibility Challenge on Merits, First Time Ever, Jan. 26

“This will be the first time ever, since this whole thing began, that it will be looked on, on merit.” Those are the words of Carl Swensson, Republican Party Chairman of Clayton County, Georgia. “This” refers to an actual judicial hearing of the case against the eligibility of Barack Hussein Obama, Jr. to be, according to the United States Constitution, “Commander in Chief” and United States President.

The attorneys of Barack Obama requested a pretrial dismissal, as it had done on so many other occasions, against so many other cases. But yesterday, one judge denied and scheduled an official hearing of the case to commence, January 26.

From 2008 to the present, judicial standing has been refused the plaintiff, often via convoluted rationale, many say sophistry. The question however is elementary to our constitutional republic: can we as Citizens be assured those presented to us for our votes are eligible to hold office?

Unlike many other states, Georgia has a statue requiring just that. For Swensson’s part, he had “resolved that I would not let anyone on the ballot who is not demonstrably qualified to hold that office.” That would appear to be part of his job as party official and it is the job of Georgia’s Secretary of State, Brian Kemp (R) to assure election law is justly carried out. Swensson relates, “We have been hounding him at hearings he’s been having across the state.”

And so it came to pass that Kemp after some delay, followed due process and called forth the court designated by Georgia law, to hear such a case. This particular case was brought by Swensson and co-litigant, Kevin Richard Powell, attorney: J. Mark Hatfield, judge: Michael M. Malihi.

As veteran Obama eligibility beat reporter Bob Unruh details at WND.com:

While Obama’s attorney, Michael Jablonski, had argued that the requirements didn’t apply to candidates for a presidential primary, the judge said that isn’t how he reads state law.

“Statutory provisions must be read as they are written, and this court finds that the cases cited by [Obama] are not controlling. When the court construes a constitutional or statutory provision, the ‘first step … is to examine the plain statutory language,” the judge wrote. “Section 21-2-1(a) states that ‘every candidate for federal and state office’ must meet the qualifications for holding that particular office, and this court has seen no case law limiting this provision, nor found any language that contains an exception for the office of president or stating that the provision does not apply to the presidential preference primary.”

Swensson and Powell’s is one of three cases, Unruh again:

The decision from Malihi came as a result of a series of complaints that were consolidated by the court. They were brought against Obama’s inclusion on the 2012 election primary ballot by David Farrar, Leah Lax, Cody Judy, Thomas Malaren and Laurie Roth, represented by attorney Orly Taitz; David Weldon represented by attorney Van R. Irion of Liberty Legal Foundation; and Carl Swensson and Kevin Richard Powell, represented by J. Mark Hatfield.

As Sharon Rondeau explains in The Post & Email, standing was even granted the one mere voter’s case. Who would have thought that a Sovereign Citizen (actually, the highest position in the United States of America) would have such authority?

Judge Malihi appeared to support Blanchard’s claim in his decision:

Both the Secretary of State and the electors of Georgia are granted the authority under the Code to challenge the qualifications of a candidate. The challenge procedures are defined in Code Section 21-2-5(b), which authorizes any elector who is eligible to vote for a candidate to challenge the qualifications of the candidate by filing a written complaint with the Secretary of State within two weeks after the deadline for qualifying. O.C.G.A. § 21-2-5(b).

A former secretary of state, Karen Handel, utilized the law when she disqualified someone from his candidacy for local office.

This was one of three rulings of Mahili on these matters, yesterday. Another separated these three cases, at the request of the plaintiffs, which he had earlier lumped together into one. Swensson respectfully explained that the integrity of his particular case required separation from the methods of at least one other case’s attorney, Orly Taitz. And as for his own attorney, about their own particulars, “Mark has been doing a Hell of a job.” (statement left unvarnished since the job of doing Hell is one of God’s own works of justice, as such, due respect).

Yesterday’s remaining ruling denied an early deposition to the plaintiffs, a move which may have brought a sense of bargaining power to the proceedings, when faced up to the Obama request for dismissal. "Statutory provisions must be read as they are written, and this Court finds that the cases cited by Defendant are not controlling."

"Code Section 21-2-5(a) states that "every candidate for federal and state office" must meet the qualifications for holding that particular office, and this Court has seen no case law limiting this provision, nor found any language that contains an exception for the office of president or stating that the provision does not apply to the presidential preference primary."

"Accordingly, this Court finds that Defendant is a candidate for federal office who has been certified by the state executive committee of a political party, and therefore must, under Code Section 21-2-5, meet the constitutional and statutory qualifications for holding the office being sought."

Yes, it’s the president’s beloved Uncle Omar, chilling out Friday night at the Chicken Bone in Framingham, the same bar outside of which he was arrested for drunk driving last summer. He’s got a full beard now, but he was easy to spot. The illegal alien fondly known as “Stinky” to the patrons of his workplace, Conti’s Liquors, was by himself, wandering the ginmill, a glass of brown water in his hand. (Read the photographer’s account below). Odd, though, that he wasn’t vacationing with the rest of the family in Hawaii — er, Asia. Guess his invitation and plane tickets were lost in the mail. It would have been easy for the Framingham PD to stake out the Bone, but it probably wouldn’t have been wise — his lawyer has already accused the cops of violating his Fourth Amendment rights by stopping him at all (he blew a .14 on the Breathalyzer). And God knows his uncle the president doesn’t mind accusing a Massachusetts police department of “acting stupidly” whenever one arrests a black man behaving badly.

The New Year will no doubt hold much excitement for Uncle Omar. First, the inevitable dismissal of the OUI charges. Then the petition for political refugee status, which will be rubberstamped, enabling everyone’s favorite illegal alien uncle to quit Conti’s Liquors once and for all and join Auntie Zeituni on the dole!
